    Hi tsikotero,

    I am new to the thread,i really need help and your opinion before i go to the lawyer on Monday.
    I just got back from abroad, i bought a car for my wife a couple of year back and place it under her name. She is claiming that i have no legal rights on it because OR and CR are on her name.what is my legal rights to reclaim the said unit? i wanted to sell the car and she wanted me to pay her half of it before i can sell it. She claim that its a conjugal property and she deserve to have half of it. I have second thought of paying her because it is my own money that i used to buy it. Please advise about legal action.

    despite zero knowledge on family law, I believe your wife (or future ex-wife) is right.

    just pay her off then get the vehicle and change ownership under your name.

    Under current Philippine laws, any items/property owned by each person will be considered conjugal property in the event they get married.

    Also, she has her name on the car's documents. She has more rights over it than you at this moment. In fact, if you plan to sell the car, you'll need her signature on the contract of sale.

    she can sell the car and keep all the money if she wanted to

    Kung civil naman kayo sa isa't isa. Sell the car then paghaitaan nyo na lang ang proceeds.

    Or kung gusto mo asarin putulin mo in half yun kotse tapos hati kayo isa may front cut isa may rear cut.

    In this case talo talaga ang OFW. Bakit di nalang nyo pag-usapan ng maayos para maibenta. Wala kang lusot talaga kapag nag demand siya ng kalahati sa pinagbentahan. Sigurado nasa pangalan ng wife mo lahat ng resebo na binayaran. Tsk, tsk..

    No legal rights, whatsoever. You are at a disadvantage just because documents pertaining to ownership is named after your wife. Even if you can show proof you remitted money from abroad, that will not establish a direct trail that money was spent for the vehicle.

    I agree. Sell the car, take half and cut your losses. Technically, she owns half of the car anyways.

    Yun na nga ang problema sa ganyan I've been into that situation pero lucky enough nagawa ko rin ng paraan . .. Just make a scenario na may utang ka sa abroad tapos you want to sell your to your friend in papers only gawa kayu ng deed of sale as scenario tapos transfer mo sa name nya para di mag duda yung Wifey mo tapos gawa ka rin ng separate deed of sale na ikaw na lang ang buyer !!!!!

    Thanks for quick reply and advised! lesson learned.and warning for all our OFW buddies there if buying a car make sure its in your name. Sometime **** happened and we cant do anything...i will go with the deal though i am paying 1 1/2 for that.

Husband OFW  paid the car under wife name,HOW TO RECLAIM LEGALLY?
