-yes if your claiming against your insurance policy
2. do i have the right to demand that i want a certain body shop fix my car or am i limited to the body shop that is accredited by the insurance?
- nope your limited to the accredited shop the insurance has to offer.
3. if i can choose the body shop i want, does the insurance company have the right to refuse it should the body shop i want is more expensive than the one they accredited? or will the insurance company just allow me to have it fix at the shop i wanted, even if it's more expensive, and they will just be the one to negotiate with the shop?
-they may allow you to have your car repaired at your preferred shop however you will no longer need to pay the deductible except you only get the cash conversion of the repair cost. In short they give you money and its up to you where to have it repaired. (the settlement is usually 70% of the repair value less the depreciation cost of your car.)
4. what if the one hit me don't have insurance, it's the insurance company's responsibility to go after him right? and i don't need to wait if the other party will pay up or not right? in short, it's their problem?
-yes it will be the problem of the insurance company, but you still have to pay the deductible and have complete papers (police report, license of you and the other car, or and cr of both vehicles.
thanks for any info.
hope this helps
