    hi guys, ask ko lang po opinions ng mga may alam about sa case ko. my car carnapped, and it was under a car loan for 4years.1 year palang ung natapos ko when the incident happend. dami din po kelangan gastosin in processing the papers at sa pag follow-up ng kaso. i heared 3months ang recovery period ng police sa car ko then kung hindi ma-recover,saka makukuha ung certificate of non-recovery which is a requirement for the insurance.

    possible po kaya na pa-hold muna ung post dated checks ko sa bank pansamantala until ma-recover or ma-replaced na ng insurance ung car ko?

    kc hirap po magbayad ng wala naman ung bagay na binabayaran ko eh.tanx po.

    Its possible, you have to request for a Stop Payment Order (SPO). Kaya lang, may charges ito, mga 200 yata per check and you must give a very valid reason for the SPO. Subject for approval pa ito, kasi SPO checks cannot be the basis for BP22 (Anti-Bouncing Check Law) cases, in case maghabol yung inisyuhan mo ng tseke.

    But for car theft cases, I doubt kung papayag ang banko. As fas as they're concerned, you have to continue your payment, the theft notwithstanding.

    Sorry to hear this pre.

    But even more sad , utang mo pa rin cya sa banko. Hope ur insurance is modest enough na bayaran un kung ano man un nasa policy. Pag d ka binayaran o feel mo kulang, Goonsquad mo na lang d2 un company.

    Once nagbayad na insurance, bayaran mo na ng buo sa banko. Negotiate sa bank na sana i recompute na 1 yr na lang para mabawasan interest kasi babayaran mo na ng buo in 1 yr. Cyempre cancelled na un mga PDC mo nyan.

    Its not P200 Sir galactus, it is P1,200 per check (P1,000 service charge + P200 daily charge). Parang overdrawn check na inohonor ng bangko. Why not talk to your bank? They will just go after the insurance company kasi meron namang mortgagee clause dun in the event na me mangyari sa kotse mo. It is what we do here sa employer ko. . .

    I believe sir hominid that whatever amounts that will be received as payment for the lost car will be forwarded to the bank. Di na dadaan sa kamay ng borrower.

    ^^eh pano yung 1 year na nabayaran na?? Syempre dapat mabalik sa owner yun.. or percentage nun depende kung magkano ibabalik nang insurance..

    OT: sa TS san po na carnapped??

    Ibabalik din ng bangko . . . Per the mortgagee clause sa insurance policy direcho muna sa bangko.

    dito po na sa project 6,qc.actually carjack po nangyari kc armado sila at dito mismo sa garahe ko kinuha,inabangan ako sa pag parking ko, they pointed an assault riffle and took my car.

    tanx sir,since may case kau na ganito like what you do to your employer, e pano po ung akin?kung hindi na dadaan sa barrower at kung ibalik man ng bank ung konti sa naibayad ko ng 1 year, eh pano po ung within the recovery period na 3 months, so continue ko parin bayaran ung checks then pag na settle na ng insurance ibalik din un?

    I think hinde pwede yan, once you received the car it is your responsibility na..labas na ang bank doon

    Yes bro, you will still have to pay for the monthly dues while awaiting settlement. What I meant when I said employer was that I am working for the auto loan unit of a big bank. Whatever monies the bank will receive from you will be refunded in due time. Sad to hear your plight bro, carjack pala ang nangyari. Makakarma din ang mga iyan bro.

    yung adventure ng kakilala ko na carnap naman after 2 months ng makuha nya. top of the line yung advanture nya. super sport. ang ipinalit ng insurance is GLS sport na lang. depreciated na nga daw yung unit kasi.

    Bro, AFAIK, iba ang charge ng Overdraft sa SPO. Mas maliit ang SPO, parang P200 lang per check.

    Teka, ma-confirm nga sa Clearing namin. Will post the results mamaya.

    Just talked with our Clearing staff. I was wrong. 2k na pala ang charges (1k for the drawee bank; 1k for the other bank, and P200/day as penalty if it remains unfunded).

    In accordance with Clearing House Operating Memo No. 380 dated January 16, 2004 from the Philippine Clearing House Corporation (PCHC), effective April 1, 2004:

    1. The service charge on returned peso cheques shall be increased from Php1,000.00 to Php 2,000.00 per item (exclusive of VAT).

    2. The penalty charge levied by the Drawee Bank against the Drawer of any peso cheque that is dishonored and returned for the reason "insufficiency of funds" or "drawn against uncollected deposits" shall be increased from Php100.00 to Php200.00 per day (exclusive of VAT) for every Php40,000.00 amount of cheque or fraction thereof.
    EDIT: Now I'm confused. I just checked the website of BPI and HSBC. The former is charging only P100 for every SPO while the latter charges P500. Apparently, each bank can set its own penalties, which is different from the returned check charges which is set by the PCHC.

    See I told ya, P1,200 if honored SPO. (Pero medyo malabo to, kasi SPO nga) No income for the other bank . . . Kung dishonored P2,200. Used to work as a clearing officer. Maybe what BPI and HSBC charges are on a per check basis (SPO fee to tag you lost/unwanted check in their system) - di pa pumapasok sa PCHC.

    If you do that you will just be opening yourself to additional bank charges.
    First you borrowed money from them to buy your car, to pursue your happiness. Your losing your car is your responsibility. So dont expect your bank to pay for your responsibility. Why would they have to suffer?

    nang babayaran dahil yon naman ang gusto mo at kalimutan na lang natin lahat?

    i think hindi nyo po naiintindihan ibig ko sabhin.m not running away from the bank. i know the papers i signed in,and i understand that its a contract. ang point ko lang po is pa hold lang ng sandali for the recovery period given by the police.
