February 9th, 2013 11:14 PM #3sa palagay ko two possibilities. 1) bayad na ang mortgage, in which case talk to the previous owner and ask him to get "Cancellation of Chattel Mortgage" from the car financing company na nag finance sa kotse. Then with the "cancellation of chattel mortgage" punta ka sa LTO and apply for cancellation of mortgage, at bibigyan ka ng bagong CR OR na wala nang "emcumbrance". 2) kung hindi pa fully paid ang bangko at hindi mabayaran ang installment, baka ireposses ang car mo. Kung tuloy-tuloy naman ang bayad sa installment, wala problema. Hintayin mo na lamang na matapos mabayaran. Then humingi ng cancellation ng chattel mortgage para alisin ang encumbrance. My advice is call up the previous owner and talk to him.
