    Hi guys

    I was hoping to get some advice for my situation. I recently got into an accident with a taxi, and all things considered, I admit I'm at fault.
    The thing is, even though I already told the driver and the operator that the vehicle would be fixed under my comprehensive insurance, they didn't want to accept this because of the "abala" of going through the insurance process, when they could just have it fixed at their neighborhood talyer for much quicker. Note the damage to the taxi wasn't THAT bad, it doesn't prevent the taxi driver from being used.

    We were discussing for about an hour, but eventually I got tired because I needed to be somewhere else so I just gave them 2500 to have it fixed themselves, after some haggling.

    My question: I'm fairly certain the proper thing to do would have been to have it filed under insurance, otherwise what's the point of getting CTPL if no one's going to use it anyway due to perceived inconvenience, right? But how to deal with this situation?

    Thoughts would be greatly appreciated. Thank you!

    kaya ka nga may insurance.. kung ayaw nila eh di sila magpagawa at gumastos..

    did you let them sign a quitclaim when you gave them the 2500?

    Yep, I have a handwritten signed quitclaim.

    So patigasan na lang ng mukha until they give up as well? What's the worst that could happen?

    That scenario is normal with PUVs...

    Baka nga di pa nila paayos yung bangga until the next LTO inspection/meter sealing.

    They get your 2500 plus they will have the repair on their own insurance ... kaliwaan ang tanggap...

    If I would be in the situation, I'll definitely insist to have it under my insurance. Sayang nmn ang payment then di nmn nagamit. Worst thing is that if the 3rd party would insist then sila pa ung magagalit dahil ayaw mo sumunod sa kanila. I suggest just give them your contact details or ask for their contact number saying to process it properly. Sayang din kc ung insurance then your gonna give pa cash to them.

    Correct me if I'm wrong, but for 3rd party injured person lang pwede gamitin ang CTPL diba? It can't be used to repair damage.

    You are right. CTPL is for Third Party bodily injury coverage only.
    e.g. accidentally ramming a taxi driver while he's standing outside his cab.
    or accidentally ramming a taxi so hard the driver bumped his head onto the cab's windshield.

    yung coverage ng CTPL, for the bodily injury ng taxi driver.
    A Comprehensive Insurance is what they need for the damages on the taxi.

    He still have to claim for the damage on his own car, tho. That's another participation fee.
    But I agree na panalo na siya since di na sasakit ulo niya sa taxi driver and the operator.

    Sorry I might have used the wrong term, I was thinking CTPL as comprehensive TPL, not compulsory

    And yes, the issue is exactly that I had to pay extra on top of my own participation fee, though it's also a fair point na positive ang not having to deal with them anymore.

    i also think good deal na less stress and 2.5k is cheap for participation. yun iba 3k or above yun minimum meron pa nga percentage.

    In most cases, your insurance will cover the costs of minor damage to your engine as the result of an accident... Insurance isn't designed to repair damage due to the normal wear and tear of your car. It won't provide coverage for mechanical failures or damage caused due to lack of maintenance.

    I would:

    1) Not admit anything, unless I'm in front of a judge
    2) Get all relevant docs (Police report, ORCRs, drivers license, contract details, etc)
    3) Leave the police station
    4) Submit all docs to my insurance
    5) My insurance will have my car and the Taxi repaired

    What? Do you think they can hold you? Do you think they will suit? Do you think Taxis have comprehensive insurance?

    Obligado ba ako magbigay ng hassle fees/expenses (pang-grab etc) sa nabangga ko dahil nde nya magamit sasakyan nya until matapos ang repair? Ipapasok naman sa insurance at sasagutin ko nman participation.

    NO, NO, NO
    You don't have to pay anyone, not even 1 centavo.

    Just give hin/her a copy of you insurance policy + the contact number of the person who sold you the insurance (a.k.a. Broker)
