Cancelling a used car deal

Hi,

Last week I acquired a used 2003 altis from a seller (owner). We have already signed a deed of contract and I have already issued a check for full payment.

Now I am having second thoughts about the car.

I am thinking of returning it and getting my money back. Is this possible? The deed of sale is not yet notarized. Or is it already legally binding?

AFAIK, any signed agreement. notarized or not, is legally binding. You just have to ask the other party if you can still undo the deal.

I agree, i think its legally binding na. Anyway no harm in asking the seller, otherwise compensate munalang siguro kahit papano kasi parang na waste ang time or he loose other potential buyers.
Just my opinion mate.

What if the seller notarized his copy of the deed of sale?

Pero honestly, Once you drive off with the car, it's yours...

Kung ako man binilhan mo nung car, di din ako papayag na ibalik mo sya...

I suggest you talk to the previous owner if he's willing to "technically" buy it back from you...

Or just sell the car.

You can ask the seller if they would be willing to nullify the sale. Although your chances are very slim IMO.

i am curious.
why do you want to cancel the sale?
is it "cold feet syndrome", or did something pop up that seems like a better deal?
if it's cold feet, i suggest you proceed with the buy.
if an emergency cropped up, then i-the-seller shouldn't mind. after all, "it could have been me and not you".

Kung meron hidden defects eh may habol ka. Alam ko sa batas parang 3months or 6months ata. Meron nagpost dati nyan.

Pero kung nafeel mo lang soli eh hindi pwede. Hindi yan parang sa mall na h&m or uniqlo na 30days you can return and change item.

Nasa batas example yung mga binaha na seller na gusto mang-gulang eh pwede mo isoli pag hindi inamin bago mag-abutan ng kwarta.

if there is a significant issue that seller intentionally kept from your knowledge, you might have course to nullify the sale.
in which case,
seller might just return your money, or
you and seller battle it out in court, and in the course thereof spend more than the sale price of the car.

i agree.
the altis is a popular car. even the old ones, like yours (TS's), still sell reasonably well.
the shopkeeper in banawe was making ligaw my 2003. he's sideline is bayan selling. madali daw i-benta ang toyota.
