    Neri fights off arrest warrant, says he’s fall guy


    MANILA, Philippines—Social Security System (SSS) president Romulo Neri Monday asked the Sandiganbayan anti-graft court not to issue an arrest warrant against him yet, saying that he may just be a “scapegoat” in the allegedly anomalous $329-million NBN-ZTE deal. The Office of the Ombudsman filed in the Sandiganbayan on Friday graft charges against Neri and former Commission on Elections chair Benjamin Abalos in connection with the controversial National Broadband Network (NBN) deal with China’s ZTE Corp.
    Neri filed a motion Monday asking the court to “hold in abeyance” the issuance of an arrest warrant—and to judicially determine if there was probable cause to indict him—because he believed the Ombudsman had “no factual and substantial basis” to file charges against him.

    ‘Sole scapegoat’

    His motion read: “It was even Neri who reported to the President and who revealed to the Senate the P200-million bribe attempt of Abalos. Is he now being used as the sole scapegoat for spilling the beans on the gargantuan bribe attempt in regard to the NBN contract because it confirmed the fact that it was actually graft-ridden which eventually led to its cancellation?”
    Neri testified in a Senate hearing in 2007 that during a golf game, Abalos offered him “200” to approve the contract between the government and ZTE Corp. to build a broadband network that would link all offices of the government throughout the country. Neri then was director general of the National Economic and Development Authority (NEDA) which reviewed the project. In recommending charges against Neri, the Ombudsman noted that he did not categorically refuse Abalos’ alleged offer but continued to “constantly confer” with him over lunches and golf games.

    In his 11-page motion, Neri said he was “never in constant conference or communication with Abalos” and that they met only on two occasions.
    He said that following the Ombudsman’s “flawed constantly meeting theory,” charges should have also been filed against First Gentleman Jose Miguel “Mike” Arroyo and whistle-blowers Rodolfo Lozada Jr. and Jose de Venecia III, among others, who also conducted meetings regarding the broadband project.

    What is the crime?

    “Even if Neri had conferred with all the said personalities, what is the crime there? Did the act of meeting with all those important personalities immediately result in Neri having acquired a financial, pecuniary or material interest in the NBN project? Definitely not!” the motion said.
    Neri’s lawyer Paul Lentejas said they would ask the anti-graft court “to determine if there is any evidence to support the charge against Neri.”
    In an April 19 resolution, released last week, an Ombudsman five-man panel recommended that charges be filed against Neri and Abalos, while it cleared President Gloria Macapagal-Arroyo and the First Gentleman of any liability.
    De Venecia had testified in the Senate that Mike Arroyo had yelled at him to “back off” the project in a meeting at a golf club. Ms Arroyo and her husband had also met with officials of ZTE in China as shown in photographs taken during the occasion.

    Ano'ng fall guy, fall gay ang pinagsasabi ng mok*ng na bop*l na ito? E, puro "executive privilege" ang sinasabi niya noong tinatanong siya dati... E si Mr. hamburjer, isinabit din ng Ombudsman.....

    well what did he expect? powers are shifting already so he should know that his immunity would not be as effective as it used to be. Heck even GMA is looking for ways to save her ass!

    Jun might have degraded his pride with what he did but he did it to save his ass... and it seems that it is working for him

    Dapat magsalita na yang si Neri...alam na naman ng buong bansa yung tungkol sa kabaklaan niya , which was allegedly the main reason he clammed up in the first place.

    Basta nga gusto niya pang makulong...andami yatang preso dun na takam sa kanya, hehehe

    this is a lesson sa lahat ng naaakusahan lalo na mga high-profile cases gaya nito. defend yourselves, when given the chance instead of just being silent or using your "executive privilege". now he is saying he is just a fall guy, when he was given what 2,3 or 4 times before to speak up on what he knows and wash his hands off from the case. neri may not be stupid but he sure is a dunce. so what if his preferred gender comes out in public, it's not like he's the only gay around.
