IIRC, GMA granted absolute pardon to Erap, so yeah, he can run again because absolute pardon practically "resets" everything giving erap a clean slate.

Section 4 of Article VII in the Constitution says that “(the) President shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time."
"The president" in this statement clearly refers to the incumbent (currently serving) gov't official. Erap can't be referred to as the "the president" here.

Macalintal isn't exactly known to be a bright lawyer. I'd take the interpretation of the UP Dean of Law anytime. hehehe.

I think sa issue na to... 2 things ang kailangan: research at collective wisdom ng Supreme Court...

    Research -

Nakasulat nga sa constitution "The President".. but looking at the minutes of the deliberations dun malalaman kung ano talaga ang intent... now if these guys going around the media circles haven't done their research on this... then they better do... now kung they did the research and they found na kahit sa deliberations ay hindi napag debatehan yun... dun papasok ang number 2...

Collective Wisdom ng Supreme Court -

ito nakakatakot... kaya kailangan ipagdasal... each of the justices have their own inclinations... and whatever they decide.. will have dire consequences...

how can you expect intelligent votes when majority of its citizens are uneducated (under-educated / mal-educated)?... but come to think of it if the Estradas were so bad then why do rich chinese flock to their kingdom of san juan to live and do business?
