malaking blunder yung ginawa nila.. di pa tapos ang debate kung proof beyond reasonable doubt ba dapat ang kailangan to convict or substantial proof lang.... so since di pa tapos ang debate, dapat conservative sila and proceed as if proof beyond reasonable doubt (worst case) and acted accordingly.. hindi masama yung they abide fully sa rules of court, while at times try nila makalusot... granted na sige... they get pogi points na tumama mga account numbers.. okay good chance for reelection na yan for the prosec.. but they weren't doing rule of law a favor... wouldn't it be better for everyone concerned na they work their way up and get the conviction the hard way? para long term, nag ma mature ang masang pilipino?

Babalik at babalik tayo sa violation ng Bank secrecy law. Here's the catch... Those annex will not be offered as evidence so lusot na ang prosec dyan.
although the annex itself may not be offered as evidence... di ako siguro competent if this can be treated as fruit of poisonous tree... i still think that Enrile should have been stricter na di dapat pinayagan basahin yung mga certifications as to the ending balance by year end nung mga accounts na yun.... a big part i also appreciate and realize, is kung di nila pinayagan yun, same scenario sa 2nd envelope ng Jose Velarde accounts ang mangyayari which yun ang iniiwasan nila... again, i point to the prosecution in doing sloppy work... gusto kasi ng prosec (at ng PNoy admin) na sila lang ang bida... they put not only Corona in a tight space.. even the Impeachment Court was somehow held hostage by all these...

Kaya nga ubod ng sipag si Enrile ngayon to the point that he will detain Leal ASAP until Leal sings a tune Enrile wants to hear. If those leaked documents indeed came from BSP then automatic bokya ang prosec. That's the fastest route Enrile can take to do defense a favor.
again, whether BSP galing ang leak or AMLC or PSBank, bokya talaga... because although impeachment is an exception to bank secrecy, again the best time for BSP / AMLC to divulge those information was during impeachment proper na... debate na lang kung what constitute impeachment proper ay starting ba sa nakuha yung 188 signatures, or yung formal opening ng Senate as an impeachment court... since in all these, wala pang rules / guidelines... mangangapa talaga...

So far wala namang bank run na nangyari sa PSBank ah, well except nung Dec 2011.

Wrong again on protection, wala tayong batas that will protect whistle blower. The only way you can protect your whistle blower dito sa pinas eh wag mong divulge info nila.

Lumang tugtugin na yan pa inhibit mo. Defense at si Corona ang gumagawa nyan.

^ Ayon nga kay pimentel regarding impeachment proceedings... Tangapin na kasi nila na sui generis kami, hindi ito criminal case.

on whistle blower law - exactly yan ang kelangan, at exactly yan dapat ang trinatrabaho ng congress... the other way to protect the witness / whistle blower is be creative in presenting the information ...

if you limit the idea na defense / Corona lang ang pwede mag pa inhibit lawfully, then bokya na agad since prosec can also move for inhibition as long as it is lawful... mag move lang naman or at the very least mag manifest lang naman sila ng inhibition ni Enrile... it is still up to Enrile / Impeachment court if they will grant or not...

now na lumabas ang angle na "Enrile is working towards making the evidence inadmissible by making Leal the scapegoat sa leak ng info".. tapos di mo imove na mag inhibit (or perhaps too late na now?), palusot lang uli yun... palusot sa incompetence ng prosecution... perhaps incompetence is a strong word.. perhaps they considered other factors kung bakit di nila ginawa yun.. kaya nga at the very least manifestation na lang...

again.. pareho din kay pimentel.. or perhaps the current proceedings against Corona isn't the right venue to do this.. but it would be a lot better for everybody that someone from the Senate file a resolution to resolve this issue... anong klaseng ebidensya ba.. rules / protocols, etc... ilatag na nila... now kung may mag question sa SC... let it be questioned... para mailabas na ang talagang proseso... hindi yung ganito na ang daming hindi pa alam.. ang dami pang hindi malinaw... lalong nakakadagdag sa gulo..

Diba nga ang sabi ni Manong Johnny about the hearsay evidence ni De Lima is that they (senator judges) are witty enough to distinguish if the statement of De Lima is hearsay or not. Tinanong yan ni Sen. Judge Pimentel on how will they go about the testimony of De Lima.
