The Prosecution apparently didn't heed the call of the Senators not to present unverified evidences and witnesses to the public...yung sa PAL tickets, schedules and perks are all over the news. Even though the CJ defense already declared that he inhibitted himself from PAL cases since 2008.

MANILA, Philippines -- After Senator Gregorio Honasan noted that the trial of Chief Justice Renato Corona was “proceeding faster” outside the impeachment court than inside it, senator-judges ended Day 11 with a stern warning to the prosecution against bringing its case to the media and introducing evidence outside its original complaint.

As an indication of a tougher regime when the trial enters it fourth week, Senate President Juan Ponce Enrile assured senator-judges their complaints about out-of-court presentations will be taken up at the chamber’s caucus before trial resumes at 2 p.m. Monday.

The get-tough mood of the court was triggered by the admission it wrung out from the head of the House of Representatives’ prosecution panel, Iloilo Rep. Niel Tupas Jr., that they will no longer present evidence on “45 properties” as they had identified only 24 so far.

Journalists attending briefings by the prosecution panel are beginning to be upset by the seeming penchant of the congressmen to blame media for the out-of-court revelations despite providing these documents freely.

The day before, Enrile had rebuked the prosecution for insisting on trying to pin Corona down for his alleged ill-gotten wealth when the Senate had specifically barred them from doing this during the hearings on Article of Impeachment No. 2, which deals with the Chief Justice’s failure to disclose his statement of assets, liabilities and net worth.

Tupas’ admission prompted Senator Joker Arroyo to remind the prosecution to present only evidence that will prove Corona committed an impeachable offense.

On questioning by Senator Francis Escudero, Tupas admitted they would be presenting only the 24 properties.

He also tried to dodge blame for this, saying, “The 45 properties is a list from the Land Registration Authority, but as far as the prosecution is concerned, so far we have presented 21 titles, including parking lots.”

To which Escudero replied: “One side already said 45 titles and here we are waiting for 45 titles. I hope this will serve as a guide that unless evidence is presented before the court, we cannot evaluate it.”

Escudero, Senator Jose “Jinggoy” Estrada and Corona’s lead counsel, former Justice Serafin Cuevas, criticized the prosecution for disclosing information it had not yet verified.

Tupas also denied the list of 45 properties released to media came from them.

“Sino naglabas sa media (Who released the list to media)?” Estrada asked Tupas.

“Hindi po kami ang naglabas (We did not release it),” Tupas answered.
But Escudero refuted this, saying: “I know that a letter came from LRA, but it was the prosecution or through its spokespersons that revealed it to the public. Again, it is putting us in a bind because the prosecution announced there are 45, but in actuality there are only 21. We might be put on a spot that we did not see here in this impeachment court all the 45 properties.”

It was the three prosecution spokesmen -- Representatives Romero Federico Quimbo, Juan Edgardo Angara and Lorenzo Tanada III -- who disclosed the 45 properties at a news conference on January 12, or four days before the start of the trial.

Representative Elpidio Barzaga said the erroneous declaration of the statement of assets, liabilities and net worth of a government official constituted the crime of perjury but he also admitted that this did not qualify as a “high crime,” the requirement for an impeachable offense.

Arroyo rebuked the prosecution, saying, “Not every omission is an impeachable offense. Even a crime that may have been committed is not an impeachable offense. The responsibility of the prosecution is to present evidence that will amount to an impeachable offense and defense must refute it. If evidence presented here is just any evidence, it is not fair to the Senate.”

The defense also chided Tupas saying, “If he (had) exercised restrain and prudence, and (done) his homework properly, he would avoid making irresponsible statements such as the 45 properties allegedly owned by Chief Justice Corona, when in fact, it is only 24 properties.”

Defense spokesman Rico Quicho said Tupas’ admission strengthen their view that the prosecution panel is not prepared to prosecute Corona.

“This is a sign of weakness on the part of the prosecution and it shows lack of condor in dealing with the matter,” he said.

Unless he has personal knowledge on an important evidence, I am pretty sure he won't testify.

And based on the on-going impeachment trial, "personal knowledge" means you saw it, read it, experienced it first hand and I doubt he has personal knowledge on any evidence. He may know something but most probably the information came from somebody else.
