Drilon should knock it off and "let the kids play basketball", as it were. He's a judge, not the prosecutor. That is, unless he intends to quit and just assist the prosecution. C'mon. These guys comprising the prosecution team aren't babies or newbies in the profession. It is lamentable that they act like it, though.

I mean, simple things like laying the foundation, identification of documents, etc. is moot court 101 law school stuff.

Sheesh. Buti na lang marking of documents is, I think, being done off-camera now. They'd be schooled no end by Justice Cuevas in admissibility of evidence and they'd look bad, if not worse.

Mario Bautista (with due apologies to anyone here related to him in the forums), should be replaced immediately. Get Simeon Marcelo or Dennis Villa Ignacio on board the prosecution and you won't see the same fumbling around in the first three days of the impeachment trials.

    nice article

One of the reasons the prosecutors seem unprepared to prove their charges against the Chief Justice as spelled out in the eight Articles of Impeachment is that the members of the House — at least those congressmen, 188 of them, were, apart from being bribed with the early release of their pork barrel and additional pork, reportedly were told not to worry about signing the complaint, even without reading the Articles of Impeachment because the congressmen were told that with all the humiliation that will be faced prior to the Senate trial, the CJ, like the resigned Ombudsman Merceditas Gutierrez, will be forced to resign and that there would be no trial.

Unfortunately for both Noynoy and the House prosecutors, the CJ decided to face the music and has already said that he has reached the point of no return and is willing to undergo trial.

But because the CJ has opted not to resign, the prosecutors are now unprepared to prove their case.

This was evident last Tuesday, when the prosecutors were caught unprepared to prove their case, especially when they sought to change the numbering of the Articles of Impeachment, and when the court allowed the prosecutors to present their evidence, obviously they were not even prepared to present the evidence, since what they showed were not certified copies that have been sworn to, but computer-generated land documents, with no witnesses to swear that these are genuine documents.

In yesterday’s hearing, it was also evident that not even the statement of assets and liabilities networth (SALn) of the CJ with which to prove their case, had to be squeezed out of the Supreme Court’s Clerk of Court, for the prosecutors to now compare the contents of his SALn, with what the prosecutors claim that he had illegally amassed wealth.

In any case, the Clerk of Court was given the go signal to submit the SALn of the CJ as it was the CJ himself who gave the Clerk of Court permission to submit his SALn to the Senate impeachment court, which only shows that the CJ did not fear the disclosure of his SALn, but was merely following the rules of the high court, which is composed of 15 justices, and not just the CJ’s.

The question now is whether the prosecution will again feast on this and spin the SALn contents for media purposes, as it already did in the case of its showing in the press conference, the so-called evidence of the alleged real estate properties the prosecution claims are the CJ’s and that with his salary as an associate justice and Chief Justice, the CJ can’t afford, in which case, the way the prosecutors portrayed it even before the trial, was that the CJ is corrupt, which is unfair, since the prosecution certainly knows, even as the SALn of the CJ has been submitted and marked as evidence, it still will have to prove that which the prosecutors claim are properties they claim are assets of the CJ that he has not included in his SALn.

Corona has always stated that he has nothing to hide, and has gone on public record that he only owns five properties, among them, the condo in a Mega World property.

It will now bear upon on the prosecution to prove that its claimed properties that belong to the CJ. Whether the prosecution can prove this or not, will be found out later, as there is still that opportunity for the defense, to cross-examine the witnesses that will be presented by the prosecutors as well as that opportunity for the defense to disprove the allegations when its turn comes.

What is certain is that the trial of the CJ won’t be finished in three months time.

What is wished for, is that the senator-judges and the prosecutors, as well as the defense lawyers refrain themselves from grandstanding and merely abide by the rules of the Senate, for the trial to be orderly and fair.

The Daily Tribune - Without Fear or Favor

hindi ba.. no evidence , no case.. swerte tlaga nila.. andyan si Drilon

    And also

I suppose you're talking about an "honest" government employee who has no mouths to feed, no rent to pay, no dependents to send for schooling. Oh, and add to that, he or she probably belongs to Salary Grade IV or higher and serving more than twenty years in government. Otherwise, there's NO WAY IN HELL that these people get Php 10Million in what? Less than ten years of government service? Unless these employees you mentioned are part of the MWSS or any other GOCC which declares huge bonuses or doles out big allowances and perks, regardless of the financial performance of their companies.
