[quoteenators question Doble's credibility, Lacson fights back

    http://www.abs-cbnnews.com/storypage.aspx?StoryId=91515

"This man is not telling the truth."

This was the description made by Sen. Richard Gordon of former military intelligence agent T/Sgt. Vidal Doble after senators grilled the latter for hours during a Senate hearing on the "Hello, Garci" controversy Friday.

In an interview on ABS-CBN News Channel, Gordon pointed out that Doble’s answers to his and his colleagues’ questions were "selective" and "evasive." He also noted the lapses in his testimonies, adding that these were not based on "his own personal experience."

The senator cited Doble’s contradicting statements during the hearings at the House of Representatives and the Court of Appeals in 2005 as well as at Friday’s inquiry.

He said that during the 2005 hearing at the lower chamber of Congress the former military intelligence agent had maintained that he was not a "wiretapper" but changed his statement during an inquiry at the upper chamber on Friday.

During the hearing, Sen. Joker Arroyo asked fellow lawmaker, Sen. Pia Cayetano, to read the transcript of Doble’s testimony during the joint committee hearings of the House of Representatives on the wiretapping controversy.

Arroyo recalled Doble's testimony denying that he was a "wiretapper."

Gordon also noted Doble’s statement during a writ of habeas corpus hearing in 2005 at the Court of Appeals. The habeas corpus petition was filed by Doble's rumored girlfriend Marietta Santos.

The former intelligence agent's family was staying at the compound of the Intelligence Service of the Armed Forces of the Philippines (ISAFP) at the time of the two hearings.

Doble denied that ISAFP was holding him against his will, prompting the appellate court to dismiss the petition.

During the CA hearing, Doble also said he voluntarily went under the custody of ISAFP because he was afraid that Samuel Ong, former deputy director of the National Bureau of Investigation, might hurt him and his family.

Ong was the one who claimed he has in his possession the "mother of all tapes" and who was supposed to corroborate Doble's revelation about the alleged Hello, Garci recordings.

"I asked him why were you afraid of Sammy Ong, could it be that Sammy Ong gave you P2 million and at that time you sided with the administration or whoever it was your siding with? He said, ‘Nagugulahan ang isip ko’ (I’m confused)," Gordon said.

Gordon said Doble claimed that the money came from Ong "when in reality it came from Laarni Enriquez." Enriquez is romantically linked to former president Joseph Estrada.

Gordon added: "It is very hard for me to believe Doble because he accepted P2 million."

Enrile also raised Doble's statements before the CA during the Senate inquiry. While flipping the pages of the hearing's transcript, Enrile murmured, "Lalabas ang katotohanan dito (The truth will come out here)."

In his defense, Doble said that even though he was testifying under oath in separate hearings of the CA and the House, he was forced to lie for fear of his family's safety.

Doble added that he was under duress during the time he made the separate testimonies.

Gordon also accused Sen. Panfilo Lacson of attempting to "coach" the witness. "There was a clear attempt to lead the witness or for that matter to coach the witness. That is not right. The Senate's dignity and mandate to seek the truth through inquiry in aid of legislation must be protected at all times."

The "Hello, Garci" wiretapped conversations surfaced in 2005. The tapes allegedly showed the President conspiring with former election commissioner Virgilio Garcillano to rig the 2004 elections.

The issue was the worst controversy to hit the Arroyo administration. Two impeachment complaints had been filed against her arising from the controversy but both had been dismissed.

The uproar it caused also pushed the President to publicly apologize for calling an election commissioner during the counting of the votes in 2004 but she denied manipulating the election results.

    Lacson defends Doble

Lacson, whose privilege speech on the controversy led to the reopening of the investigation on the scandal, accused pro-administration senators, particulary Gordon, Arroyo and Enrile, of "bullying" the witness.

"You know some administration senators tried but failed to disrupt the proceedings; not only disrupt but they tried to bully the witness- Gordon, Enrile, Arroyo - they took turns in battering the witness. And we shouldn't do that because this is our resource person." he said in a separate ANC interview.

On the CA hearing, Lacson pointed out that it would be impossible for Doble to go against ISAFP while under the agency's custody, adding that Doble was under duress and intimidation at the height of the issue.

Lacson also said it was possible that Doble lied during the hearing at the House of Representatives because he was heavily escorted.

He said the P2 million, meanwhile, was handed to Doble two months after he released the tapes, thus, he maintained, it was not considered a bribery.

"But you know he could have denied it but he admitted receiving the P2 million. That should [strengthen] his credibility.... Receiving the money is bad for Doble, but admitting it, that would take a lot of courage," he added. [quote

talagang nakakatakot. noon 2k5 he was very vocal on this issue. it's so simple lang naman talaga. the people should learn to sniff kung sino makikinabang sa isang issue na ganito at yun ang dapat pagsuspetsahan.

[QUOTE=Monseratto;894817]Nakakatakot to think that Lacson is a presidential wannabe. Patay tayong lahat kung maloloko niya yung masa.

    No coaching please

The additional information shared by Lacson during Friday’s hearing, however, triggered a flurry of debates with Sen. Richard Gordon.

Gordon said Lacson should not have offered any information to corroborate Doble’s testimony to establish the identify of Poblador or anyone involved in the controversy.

Gordon was particularly irked over Lacson’s coaching attempts and his offer to become a witness and testify before the joint committee in the attempt to corroborate Doble’s testimony.

“As lawyers we have to abide by the rules of investigation in the interest of fair play,” Gordon remarked.

Gordon said Lacson should have gotten a better witness since under the rules of evidence, perjured witnesses are no longer allowed to testify.

He said Doble was not telling the truth and so he bluntly told Lacson not to “coach (Doble) because we are after the truth here.”

“Everytime the witness has to answer something, he (Lacson) will say something that the witness can hear. We are strict on that. You cannot coach a witness on sensitive issues,” Gordon told Lacson.

Lacson, for his part, blurted out: “Don’t tell me what to do.”

Lacson said it was obvious that the three senators wanted to delay the proceedings and ruin Doble, referring to Senators Gordon, Juan Ponce Enrile and Joker Arroyo.

“Doble has details of the truth and his spontaneity in answering questions (makes him credible.) If you are telling the truth, it is easy to see and hard to shatter. The P2 million came two months after he released the tapes. I don’t know if you call it a bribe,” he said.

Doble was all alone Friday in his testimony before the hearing which was marked by endless debates among senators.

Emotions ran high as senators debated on Doble’s credibility as the main witness in the investigation.

Tempers flared up as debates seemed to overshadow Doble’s testimony.

Doble was not able to elaborate on the alleged wiretapped conversations between President Arroyo and former elections commissioner Virgilio Garcillano, except on what he earlier revealed as his role in the Military Intelligence Group 21 (MIG-21) of the Intelligence Service of the Armed Forces of the Philippines (ISAFP).

Senators Arroyo, Enrile and Gordon, for their part, questioned the credibility of Doble in describing him as a perjured witness.

Arroyo said Doble himself destroyed his credibility as “star witness” for admitting getting paid P2 million to turn over the copies of the taped conversation to former National Bureau of Investigation (NBI) deputy director Samuel Ong through a certain Angelito Santiago.

Arroyo, Gordon and Enrile, as lawyers, pointed out Doble’s earlier statements in the House of Representatives and Court of Appeals where he denied the wiretapping activity.

Enrile also questioned Lacson for providing the information on Poblador.

Senate Minority Leader Aquilino Pimentel Jr., on the other hand, raised his voice against Senator Arroyo for blocking Doble’s testimony.

“Why don’t we allow him to explain?” Pimentel told Arroyo.

Sen. Rodolfo Biazon, chairman of the national defense committee tasked to lead the hearings, had to act as referee a number of times to pacify the senators and cut short their questioning.

Lacson assailed his colleagues for hitting the credibility of Doble.

“You cannot satisfy these people, people like Gordon, Enrile, Arroyo and the others, you cannot satisfy them. No matter how many witnesses you present, they will never be satisfied because they have their own mindset. Their mindset is to protect Malacañang,” Lacson said.

Kapag ang tao ay nagsasabi ng totoo lalo na under-oath,kahit bali-baliktarin man ng mga investigator ang mga tanong,di pa rin yan makakalimutan kahit 10 years ago pa yan at always one and the same answer, pero itong Doble,paiba-iba mula Lower House to the Court up to the Senate, inconsistent sya,mga senator-lawyers pa nakaharap nya...paktay na!... diversion tactic ni lacson yan dahil sa U.S. spionage conviction of his two lieutenants here in which the federal government send tape copies of the said conviction proceedings to the Philippine DOJ already...

There is always the other side of the coin. A lot of people are focusing on Doble's conflicting testimony...but how about the government side? In every legal proceedings, the burden of proof is always on the accusers side. Kaya nga every little hole the defendant finds, ay iniexploit nya ito to create doubts on his allegations.

If we go back when this issue (Garci tapes and wirtapping)was originally brought open into the public. Almost lahat talagang naniwala that there was really a massive cheating and conspiracy sa electoral process. Kaya nga si GMA eh humingi ng public apology (braodcasted into TV's)about her calling a commision on election officer (Garci). That can only translate that she really did call him (Garci). And the hello garci tapes was the proof. What the government side did was systematically demolished the tapes credibility and Doble's testimony. If you can remember, nung nagtatago pa si Doble sa Guadalupe Seminary, first thing na ginawa ng ISAFP is to get hold of Doble's Family, put them into ISAFP custody and used them para makuha nila si Doble. Thats when ISAFP started a brainwashing and coaching before they presented him to Senate; with several escorts at that.

Bro matagal ng one side ang issue na ito against administration kaya i think this is just a cross examination versus opposition kung talagang totoo eh parang hindi!! Enrile being a long time opposition smells something fishy

It' a crime to wiretap, and it is a crime to use a wiretap by talking about its contents.Constitution's"BILL OF RIGHTS on Privacy of Communication" says
"That an ILLEGAL WIRETAP is inadmissable for any purpose in any proceeding".
We have "Anti-Wiretapping Law"...Sen.Angara said;..the problem with Lacson is, he can not understand Legal Matters very well.
