De Lima order to hold Arroyo is it unconstitutional ?

sir and ang pagkakaalam ko eh... theres no legal reason to bar gma from leaving the country bec... theres no HOLD DEParture order issued to her at that time... 2nd theres no warrant for her arrest... 3rd no case is filed against her... in court and no HOLD departure order has been isssued... ANG meron lang eh yung WATCH LIST ORDER COMMING FROM DOJ... a watch list order is not a hold departure order... kaya po yung legality po nun ang question ni gma sa s.c.... pls dont get me wrong im not on gma side... or s.c. side... its just my experience with s.c. and just sharing you a piece of my mind.... peace mga veteran tsikoteers....

WLO is the same with HDO, ibang term lang ginamit...para hinde na dumaan sa korte...you also need prior approval from the DOJ bago ka makalabas...

HDO for the judiciary and WLO for the executive...same banana :barmy:

ikaw lang yata nagiisang nagsasabi na kakampi ng admin ang SC...

there is WLO to stop the arrovos..until hinde pa nag decide ang SC na unconstitutional then that is still valid...

kaya hinde totoo yun sinasabi mo na there is nothing to hold them from leaving...eh di kung wala bakit kailangan pa mag issue ng TRO ng SC? wala naman palang legal ground yun WLO eh...

^^ oo nga, hindi ko makuha yun logic in issueing an WLO but not prevent them from leaving the country para saan pa yun WLO, para tingnan lang ng Immigration yun mga tao sa watch list?

UNDER PA DIN PO yan ng higher court or S.C..... binigyan nila ng tro then.... after a few days... before makaalis nag issue din sila ng hold departure order... he...he... kailangan muna kasi nila ng legal na basehan para hindi makalabas ng bansa si gma....

another way po yan or what we call extra legal way.. para ma hold temporarily ang mga ayaw ng gobyerno na palabasin... kailangan muna sila kumuha ng clearance sa doj... before leaving the country....

the action of the SC not only with this case but ever since the pnoy admin started says otherwise.

wala pong na issue ng HDO order ang RTC, yun lang ang gusto ng comelec/doj but warrant of arrest na agad ang na issue kaya automatic hinde na kailangan ng HDO para hinde makaalis, which sinabi rin ni Midas na since meron ng WOA hinde na pwedeng umalis si pandak.

yes RTCs are under SC pero independent pa rin sila when it comes to decisions...

the s.c. issued the tro sa dept. circular ng doj... re. wlo... w.c. the arroyos questioned the legality sa s.c.... so sir actually ang TRO NG S.C. EH yung DEPT. CIRCULAR NG DOJ... AT the same time na wala naman kasing HDO comming from the court....

alam nyo po style po talaga ng s.c. yan ganyan... matagal na... diskarte po ang tawag dyan... kung talagang kumakampi ang s.c. kay gma edi sana hindi na po sila nag issue ng HDO... ANG NAG issue po ng HDO EH lower court w.c is under ng s.c...

bakit extra legal way? eh meron presumptions of regularity dahil ang nagissue naman nun circular eh from pandak's admin...saka hinde pa naman sinasabi na illegal and unconstitutional eh..so legal way pa rin yun...

same din po... nag palabas na din po sila ng warrant... so may dahilan na para hindi makaalis si gma...

EXTRA LEGAL MEANS gumagawa sila ng paraan para mapagbigyan kung sino man yun gusto nila pagbigyan... the legal way... like 15 days to comment... not w.in 24 hrs. to comment... si de lima...

kaya nga sir nag issue ng tro dun sa circular ang s.c. kasi nga they think its unconstitutional.... its not yet illegal... yung legality po nun ang inisuhan ng tro...
