    kung mag file sa monday sa Sandiganbayan then may malaking chance pa sila Arroyo na makalabas ng bansa

    RT *Karen_DaviLa Comelec comm. Rene Sarmiento says under the law, "electoral sabotage cases" are to be handled by RTC not Sandiganbayan.

    ^ My strong guess is mas madali kasi sa RTC kesa sa Sandiganbayan kaya nakalimutan nla na dapat or mas proper na sa Sandiganbayan dapat na-file.

    I hope hindi ma-tetechnical. Sayang, non-bailable pa naman! :mad:

    Based on the Omnibus Election Code, which the case falls under...

    Exclusive Jurisdiction of RTC

    Regional Trial Courts have exclusive jurisdiction to try and decide any criminal action or proceeding for violation of the Omnibus Election Code - Under Section 268 of the Omnibus Election Code, regional trial courts have exclusive juridiction to try and decide any criminal action or proceeding for violation of the Code, "except those relating to the offense of failure to register or failure to vote." The said provision reads: "Sec. 268 Jurisdiction of courts. The regional trial courts shall have the exclusive jurisdiction to try and decide any criminal action or proceeding for violation of the Code, except those relating to offense of failure to register or failure to vote, which shall be under the jurisdiction of the metropolitan or municipal trial courts. From the decision of the courts, appeal will lie as in criminal cases."
    Would be interesting to see a battle of legal minds over this...
