    ang problem namin ngayon is negotiation. ung kabilang partido kasi ito ang hinihingi.

    insurance namin plus participation fee. plus humihingi ng danyos.

    all of whicj are not in the agreement.

    gsto ko lang malaman as to how far can we invoke our contract. kasi nagsabj dn ang puljs na mag abot ng danyos. so i asked the other party kung magkano ba ang gstk nyo pero hndi ho akk pumapayag pa.

    Well, I am not a lawyer, but if that happened to me and the other party signed a quitclaim, that's already it. I doubt if they will even pursue a case, kasi may insurance naman sila and a case is expensive and tiring. Tinetesting ka lang siguro, if you give in swerte, tabla panalo lang habol nila, they don't lose anything by trying

    Hello newbie here! Eto po kasi ang thread na nakita ko at sana may makapagbigay ng advice sa amin.

    My brother-in-law was involved in a vehicular accident and got an open fracture on his right foot and the sad thing is, his right leg below the knee was amputated and the other party naman damage yong windshield & right bumper ng car.

    My husband and his niece went to the police station to talk with the other party. They agree to go to the lawyer para ma-notarize ang agreement na sa CTPL nila kukunin ang bayad for the repair ng car nila at ang sobra sa hospitalization. Pero hindi natuloy ang pgpunta sa lawyer dahil binigyan nila ng assurance ang husband ko na meron silang isang salita na ibibigay talaga nila ang pera pag nakuha na ang insurance. Nagtiwala naman ang husband ko kasi pareho sila na government employee. Pumirma sila ng settlement sa police station na kanya-kanya ang bayad sa damages (pinakamalaking mali na ginawa ng husband ko). Wala naman po nakalagay sa police blotter kung sino ang may sala.

    As of this writing nasa hospital pa ang brother-in-law ko. Paano po ba nila ma-claim ang insurance nila?Ang sabi nila itago lang daw namin lahat ng resibo. Gaano po ba katagal ang processing ng insurance?Pwede po ba kami maka-demand sa kanila na magbigay naman ng tulong financially kasi anlaki npo ng hospital bill namin? At pwde po ba talaga pumirma ang husband ko dun sa settlement in behalf of his brother? Maraming salamat po sa mga sasagot.

    Those police officers were retards. Mga kinain ng sistema. They were just the investigators.
    Hindi sila magla-label ng kung sino ang may fault sa accident unless one of the party admitted to it.
    And in case na magkademandahan kayo, sa korte magkakaalaman kung sino talaga ang may fault.

    First of all, dapat di kayo pumayag na kayo ang may kasalanan kasi you stated that the other vehicle recklessly turned left entering the establishment without using any turn signal leaving you not enough space to brake and safely evade the reckless vehicle, hence, the collision. Mas okay na paulit ulit i-emphasize ang fault the other party sa side ng iyong police report.

    Though, I have to admit, this would be difficult on your part and need nyo ng good lawyer.
    Kung maaari, get some cctv footage that could have recorded the accident sa area.
    Invest on a dashcam since you do not have any insurance for your protection.

    Do you have a copy of the notorized agreement? If that document favors you, then gre.
    Adhere to what's stated sa notorized agreement na kung participation fee lang ang napagkasunduan nyo,
    panindigan mo yun since obviously, namemera nalang yung kabilang party.
    Make sure na you get the Certificate of No Claim from their insurance para di ka nila habulin.

    Depending on the settlement na pinirmahan ng husband mo (yes he is lawfully recognized to sign on behalf of your brother-in-law; his brother?), which most likely states, na sasagutin naman ng other party ang lahat ng gastusin sa hospitalization and medication.. sana kasama dun sa napagkasunduan nila ang therapy and further issues arising due to the accident without relying sa CTPL alone kasi iirc, there's a cap or limit to how much one can claim via CTPL. I think its only just around 50k medical and hospital expenses.. and maybe including the disablement of your brother in law. Meaning, maaaring hanggang jan lang ang maclaim nyo thru CTPL.

    You'll just need the assistance of the Police Precinct to contact the other party para may record if they are cooperative or not.
    Though, I am not sure on how far you could ask for a demand since it was not clearly stated na the other party was at fault.

    Yes sir hindi po nakasulat sa blotter kung sino ang may kasalanan. Nag turn left po kasi yong car tapos straight direction ang brother-in-law ko. Unfortunately po sa pinirmahan ng husband ko, states that they will shoulder their own damages & hospitalization. I believe yan yong reason kung bakit kahit sa CTPL na pinangako nila verbally ay hirap na hirap kaming kunin sa kanila. Incident happened last Sept 26 and we just found out last Monday, Oct 1 na hindi pa nila na-file yong claim. Nong tinawagan ko, sabi nila they were advised ng insurance company na ilipat muna sa name nila ang registration ng sasakyan kasi kung hindi sa original owner mapapangalan yong cheke. Ang sabi lang nila sa amin ay itago ang resibo at hospital bill na isa pala sa requirements para ma-process ang claim. And yes tama po kayo sir nasa 50-60k lng po ang estimated amount na makukuha from CTPL. And sabi ng taga insurance, ok lang naman kahit hindi pa na-transfer sa name nila ang CR. Mapupunta rin sa brother-in-law ko yong claim at hindi na dapat sila humingi pa ng share nila para sa damage ng sasakyan. Pero kung hindi nila e-provide yong mga requirements sa insurance company gaya ng photocopy ng policy at or/cr ay hindi po talaga ma-process ang claim.

    Nung kinuha po namin ang sketch sir sa police station, labas na raw po sila sa verbal agreement. Pero balikan po namin to ask for assistance para naman makipag-cooperate na yong other party.

    Sa tingin ko masyado na kaming mabait sa kanila. Sana hindi agad pumirma ang husband ko at ng nabulok yong sasakyan nila sa barracks. Inaasikaso pa namin ang patient namin tapos they keep on calling sa husband ko na kelangan magka-ayos na kasi gagamitin na nila ang sasakyan. Tapos ngayon na kami ang tumatawag, hirap na silang maka-usap.
