Is it fenced? Is there a sign saying: NO TRESPASSING? Does the owner assign a caretaker? There is such a thing as Trespass to Property punished under the Revised Penal Code.

The irony of it all: Law abiding, tax paying citizens like Boybi who have good intentions on using the lot where he intends to pay for the upkeep and rent are careful to make sure they don't get into trouble with the owner while on the other hand, squatters just enter and destroy any property they can get their grubby hands on and demand for payment and consuelo just to move out.

If it is not fenced, there is no Trespassing to a Fenced Estate or Property to speak of. But, yes, good human relations would always tell us it is not just to violate one's feelings.

For purposes of academic discussion:
When you can't find the lot owner and if you happened to utilize the lot for parking, you can always set up a defense that you are securing it from the lurking squatters. As you said you are willing to pave it and if it happens that the lot owner likes the improvement and considers the same as necessary, then a relationship called Negotiorum Gestio is created. So if he wants you to pay for the rent before the court, then you can ask the court for a just and reasonable rent payment.
