The purpose of mediation is for both parties to amicable settlement. If not, the hearing officer will refer the case to the court for preliminary conference. Since your case is covered by summary procedure, your presence is very important especially if you are notified of such hearing otherwise kung absent ka especially in arraignment, the judge will issue a "bench warrant" for your arrest unless you have a valid reason for being absent.

As a rule, all criminal actions commenced by a complaint or information shall be prosecuted under the control and suoervision of the public prosecutor ( fiscal ). Ang impotante dyan is dapat meron ka private counsel to defend your case.

Yes, we already have a counsel, hassle lang kasi na kailangan lagi need pumunta sa court sa walang kwentang kaso nato...

sabi nga ng mga iba...sana pinapatay ko nalang raw...hehehe...sabi ko walang thrill kung patay na kalaban...mas maganda parehas lumalaban sa katotohanan..kung sino talo...e magbabayad..

halos araw araw nagkakasalubong kami ng complainant samin..

dedma lang, parang hinde lang magkakilala... hinde naman sila yung nangiinis or papano, hinde kolang alam kung baket ako talaga dinidiin nila..e base naman sa evidense nila...halos hinde mo makilala kung sino yung tao...kasi malayo at pixelated na yung video..tsaka ang daming tao dumaan sa kotse niya...baka yung mga dumaan walang pambayad kaya naghanap ng tao na may kaya magbayad..hehehe

worst pa nito..pinaboran ng prosecutor...sabi hinde raw ako sumipot sa preliminary investigation...e wala nga ako natangap na subpoena galing sa kanila eh..

ang alam ko sheriff ng city hall ang nag dedeliver na ganun dba? if yes then wala kami natangap..

kaya umabot sa court eto dahil hinde raw kami sumipot sa preliminary investigation...e pano kami pupunta..kung hinde sila nag padala..hehehe

Update mga sir, done with the arraignment and mediation 1st and 2nd session.. no settlement kami..although willing to settle yung complainant for 30k. now case is being endorsed to JDR (Judicial Dispute Resolution) court, mediation nanaman but before a judge naraw.. waste of time really have to go through this, no settlement padin naman kami..i think after this tsaka pre-trial na, para magkaalamanan na mga ebidensya meron sila na walang kwenta at puru imbento..

What i hope here is that maging honest sila sa statement nila.. kasi base sa evidence nila..malabo talaga yung kuha at madaming tao, pedicab and sasakyan na dumaan malapit sa sasakyan nila.

i think its up to the prosecutor to present their case at panindigan nila yung evidence nayan..hehehe..nakakatawa lang isipin na ganun situation pala pwede kang kasuhan kahit napadaan kalang at wala kang summon natangap for the preliminary investigation, resolution agad tapos may kaso kana..
