    hayaan mo lang siyang magdadadaldal basta ikaw tahimik ka lang less talk, less mistake ika nga.

    Hello Mga sir...

    Updates:

    Arraignment po namin friday kaninang 8:30am sa Manila MTC, i plead not guilty shempre, then judge sent us to manila mediation center for possible settlement...

    at the manila mediation center, these people want me to pay 15k+ toyota quoted price of damage + 15k loss income + 5k filing fee of the case and 500 for the mediation fee.

    of course no settlement ako, then the mediator resched us for another mediation again. Ilan mediation session poba eto? forever hangang hinde kami nag settle?

    Sarap sampalin yung kapitbahay namin...yabang magsalit, sabi pa niya "hinde ko naman kailangan ng pera, gusto kolang turuan ka ng leksyon" WOW! the face...hahaha

    if i understand, if hinde maayos sa mediation center yung settlement, proceed naba siya sa hearing? or another stage of settlement nanaman?

    waste of time really, kasi no settlement talaga kami, we are willing to pay our lawyer than our neighbors kasi at the end mababawi naman namin yung gastos namin after namin sila kasuhan for damages.

    My question here is.

    1. will i need to be in every court hearing? or may lawyer can represent me kahit wala ako dun?
    2. need ba kumuha ng private lawyer yung complainant? or the court will provide one for them for free?
    3. will the complainant need to be there on every court hearing if ever they have a private lawyer or PAO?

    1. It is a criminal case, better to attend unless your lawyer advices you that it is ok.
    2.In criminal cases, the prosecutor will prosecute in behalf of the state. unless the complainant wants to have a private prosecutor to prosecute, but then the public prosecutor must give their consent and/or approval.
    3. PAO cannot act as a private prosecutor. The complianant need not be present in every hearing unless required.

    i agree.

    i want to add only a couple of things:

    1) arraignment pa, so wala pang pre-trial, right?

    pre-trial is mandatory now in criminal cases.

    the parties, the accused, the private complainant, and their respective counsels MUST be present during the pre-trial.

    2) so that the court may dispense with your presence in court during the subsequent proceedings after the pre-trial, you need to stipulate with the prosecution (i assume your lawyer knows this basic procedure) that you are the person charged in the person. the proper time to do this is during pre-trial.

    Hello sir,

    Currently nasa mediation center case namin, 1st session alang nangyari, nextweek po 2nd session...malamang wala din mangyayari hehe

    After mediation pre trial napoba sir?

    Also wala naman cousel ung complainant...do they need to get one? Or pwede nalang sila umasa sa fiscal on the day of the hearing?

    They can get their own, pero it's the fiscal that will represent them in court... Ask ko Lang anong branch sa manila?

    Patagalan nalang kayo... Sigurado ako this will drag for years... Imagine pag sa MTC ang naka set per day NASA 30-50 cases-- magsasawa kayo sa tagal.. At kakahintay na tawagin case nyo.. By the time, promulgation mo na... Legal Experts na kayo...

    Or if you want mapabilis, request mo sa court interpreter... Unahin kayo bulong mo Lang ha... Or kung gusto mo naman tumagal... Look for holidays, dun mo request set Yung hearing nyo... Kunwari available mo on that day Lang... Most court interpreter hindi sila nag mamark ng legal holidays sa calendar... Tira Lang ng Tira mga yan...

    The best legal move is bayaran yung judge. Hanap kayo ng branch na corrupt. Mostly corrupt kaya hindi na kayo mahihirapan.

    Thank you sir sa mga feedback...

    No need to do illegal na process dito...am ok with how the case is going, if hassle gusto nila then be it..

    Flexible naman ako sa oras ng pasok sa office..kaya pwede ko adjust para jan..

    Obligado poba kumuha ng private lawyer yung complainant? or yung fiscal ng court nalang ang hahawak sa kaso nila?

    some court kasi require's complainant their private lawyer..or else reset the hearing.

    Sa stage na ganito, pwede koba sila kasuhan for malicious prosecution and civil case for damages? kahit hinde pa tapos current case namin?

    Im sorry pero yan ang katotohanan. Pag criminal cases wala akong kilala na puwedeng bayaran. Pero sa mga claims at ibang settlement maraming judge ang tumatanggap ng bayad.

    Settlement? Settlement between parties Lang yan... Wala nang control ang judge sa settlement nila...

    Never in my 18 years in the judiciary I heard a judge ask for money in a settlement or compromise agreement..

    Yung judge pa nga nag nag propromote ng compromise para hindi na tumagal ang Laban nila..
