    With regards to rules and regulations on violations ng mga home owners, ano ang powers na kayang i-exercise ng mga association officials sa mga offending home owners?

    For example, which is the usual problem, ay mga pasaway sa parking. Either blocking other home owner's slot or parking in slot reserved for other home owners. Or mga pasaway na mag-park, hirap na hirap ka lumabas ng parking mo dahil may double parking sa tabi ng unit mo.

    Another example, yong mga maiingay - videoke, karaoke.

    And yet another, yong mga nagsasampay ng mga damit. May mga townhomes bawal magsampay ng damit sa harapan ng bahay, ano magagawa ng association for repeated offenders?

    Natanong ko lang, kasi parang walang power ang association minsan sa mga pasaway na home owners.

    The extent of power or authority which a homeowners association has should be defined in its Articles of Incorporation and By-Laws (as registered with the HLURB).

    Also, check your Master Deed with Declaration of Restrictions which is supposed to be stamped or printed at the back of your TCT.

    Seriously though, you can proceed independently of your homeowners' association by going to your barangay and making a complaint. If things aren't settled there, you can file a case for unjust vexation against the offending neighbor.

    Iyan ang laging mga problema natin,- may Homeowners' Association man o wala....

    Sa amin,- may mga pagkakaataong parang toothless tiger din ang Association.... Dapat talaga, may professional Village Administrator, na hindi residente, para may maganda at maayos na management ang lugar...

    Your bylaws allow for fines. Have the association (everyone who shows up at the next meeting) set and issue a fine for each current and future violation with notification to the owner with a quotation from your bylaws. If these fines are not collected in a timely fashion the condo association could then file for a lien on the property to secure payment.

    thanks for the replies mga sir.

    another question: can a new entry in the rules & regulations/bylaws of the association be created by the association itself? for example, if majority of home owners would agree to a rule to only allow 2 vehicles be parked per unit at any given time within the subdivision. can that be easily created, or does it need HLURB involvement?

    our subdivision(with around 50 townhouse units) has a provision for parking 2 vehicles per unit. problem is sometimes some a$$hole homeowners (owing just one unit) park 3 or more cars at a time, kaya nagiging masikip minsan ang mga common areas. wala rin silbi pagsabihan ng president of the assoc, kasi after a while, balik na naman sa dati.
