    Yung charges daw that will be filed by Vhong group include Serious Illegal Detention. They said that applies if you hold a person against his will more than 24 hours...Sabi ni Cedric the incident only lasted ONE hour before they brought Vhong to the Polce Precinct. If pumayag ang NBI na magfile ng case, special treatment na iyan. Non-bailable yung charge na iyan.

    Err...not quite special treatment.

    The definition of serious illegal detention aka kidnapping still applies since (i) serious physical injuries were inflicted; and (ii) there is an allegation of extortion of money aka ransom from the victim. So kahit 30 min. lang yan, kidnapping or serious illegal detention pa rin siya.

    "The elements of the crime of serious illegal detention under Article 267 of the Revised Penal Code are:

    1. That the offender is a private individual;

    2. That he kidnaps or detains another, or in any manner deprives the latter of his liberty;

    3. That the act of detention is illegal, not being ordered by any competent authority nor allowed by law;

    4. That any of the following circumstances is present:

    a. That the detention lasts for more than five (5) days; or

    b. That it is committed by simulating public authority; or

    c. That any serious physical injuries are inflicted upon the person kidnapped or threats to kill him shall have been mode; or

    d. That the person kidnapped or detained is a minor, female, or a public officer. 4

    This Court has held that in the crime of kidnapping or serious illegal detention, the offended parties "need not be kept within an enclosure to restrict their freedom of locomotion . . . . It is enough that they were in any manner, deprived of their liberty, unable to move as they pleased . . . ." G.R. No. 94704

    Question lang..Assuming lang na nahuli nga sa akto ni Mr Lee si Mr Navarro na nagsisimula na gahasain si Ms Deneice at napigilan gaya daw ng nangyari, pero hindi binugbog tinali lang at dinala sa presinto agad, yun ang ok?

    AFAIK, merong liability for slight illegal detention kasi hindi naman nila tinuloy ang pagsampa ng kaso. Pero, kung hiningan nila ng pera katulad ng sinalaysay sa balita, kidnapping with ransom pa rin.
