the lady burned herself when the hot drink she bought from the fastfood spilled onto her as she was driving.
the us court awarded her a handsome amount because, i believe, "the drink was too hot"..
in the phils, she might have gotten zero + admonition not to drink and drive.
the law is strange.

1) McDonald's coffee really was too hot! 180-190°F
2) The woman ended up with multiple third-degree burns.
3) An expert from the University of Texas testified that the level of risk with handling liquid that hot was unacceptable.
4) She only asked for medical bills and lost income, to the tune of $20k. McDonald's made an insultingly low offer of $300, which is why they went to court
5) After they lost in court, McDonald's went on a smear campaign to somehow set up her image as a litigious, looney old woman. To this day the case is famous as a frivolous lawsuit that won jackpot damages. Sya na aggrieved party, sya pa siniraan.

October 23rd, 2019 04:03 PM #244The issue is the case is known for being frivolous, which it certainly wasn't.
The main reason why the damages ballooned was because of McDonald's callous and indifferent behavior throughout the hearings. They could have settled for much less.
$2.7M was punitive damages tacked on by the jury to teach McDonald's a lesson.
