Ang root nitong misconception o wrong info na ito ay ang pag-ipit sa car driver. Many times, ito ay nag-uumpisa sa pulis. Tatakutin muna ng pulis ng bilanggo ang driver ng kotse dahil baka maglagay nga. May lagay na si pulis, may settlement pa si rider. Many times pati si sulsol star witness eh pera pera din na tatakutin ang driver. Nahahawa ngayon ang attitude ng rider o pamilya ng namatay na rider dahil sa pakay ng pulis at sa sulsol ni witness. Kung madaling matakot at walang koneksyon ang driver, maaring mag wagi ang sistemang mali. Pero pag natakot ang pulis sa driver, iba na ang labanan. Batas at hustisya na ang iiral.
if anyone bumped me while i'm on my car and asked na ako pa ang magbayad e ako na nga ang binangga (given of course na wala naman akong violation that resulted to that particular accident ex: beating the red light, swerving, drunk etc) then he can kiss my sorry *ss at baka ako pa ang magsampa ng demanda laban sa kanya kahit sabihin na natin sobrang dehado na siya...
Hindi naman siguro tama na automatic bayad agad ang naka cage sa naka MC pag may banggaan... If this holds water, madaming "enterprising" pinoys na gagawa ng paraan at pagkakaperahan ang mga naka cage gamit ang ganitong premise...

Isa lang ang general rule tungkol sa mga bangga.
Considering na walang violation (or road-ledal) ang binangga, ang may kasalanan ay ang bumangga (no matter how small it is).
BASTA WALANG VIOLATION ang binangga (naka helmet, updated registration, may lisensya, hindi nag-swerving, hindi reckless driving, etc), mananagot ang nakabangga.
PERO, kung ang binangga ay walang lisensya, walang rehistro or may nagawang violation prior to the accident, sya ang mananagot sa nakabangga. Kahit na motor lang sya at 18-wheeler truck ang binangga nya... kahit sugatan sya. In cases like this, hindi tatanggapin ng TPL ang claim ng non-road legal na nakabangga/binangga.
Knowing your rights will help in dealing with accidents so you can make the most out of bad situations.

In an ideal scenario, yeah. But ang traffic cop, nasusuhol sa precinto mismo. Kahit na ikaw tama, kapag nasuhol na ng kabilang party, the story will be different when the traffic accident report comes out.

tingin ko, putting the blame mainly on the corrupt system and on the lack of assertiveness on the part of the driver is just another classic example of what some here calls "tyrany of the weak".

There should guidelines or laws about how motorcycles can lane split and filter, because I see these practices as among the most rampant causes of motorcycles hitting vehicles (and sadly, getting away with it).
- Filter forward only when it is safe, i.e. traffic is less than 20 kph
- Only lane split if the lanes are wide enough, and only if the guidelines are broken (not solid)
- Lane split only within lanes going the same direction, no lane splitting between opposing lanes
- The responsibility of ensuring a safe filter or lane split rests with the motorcycle rider, and in the event of an accident, it is the rider who is more liable (similar to when we car riders hit a pedestrian who jaywalks)
- The moment a motorcycle rider causes damage to a vehicle or hurts a person while filtering/lane splitting, and the rider has violations (improper riding gear, no helmet, no/expired license, no plate/sticker on the motorcycle, and similar), they are automatically at fault
I think these proposals are fair. Any motorcycle rider who practices safe motoring should see that these proposals are reasonable, while I myself am willing to negotiate on the provisions to arrive at a common ground that is beneficial to all.
On the other hand, arrogant, uneducated, and idiot riders -- I'm sure -- will start to holler "Facism!" My response? Pay up on all the damages you caused, you irresponsible cheapskates!

My friend's experience beg to disagree with the "policeman having no right to choose who is wrong." Well, actually, despite what you may have said may be true, it still happens in the typical, brazen way.
How? Traffic investigator suddenly changing/twisting the story said in the traffic report in complete defiance of common sense. You only get to see it after the traffic report is released a day or more (if they want to delay it para mawala ang init)
Ayan, kailangan mo pa magtawag ng abogado para matuwid lahat, which is sobrang hassle sa mga walang easy access sa lawyer. This is what the corrupt traffic investigators are expecting. Siguro sa mga malalaking accident, they won't try this, but for smaller scale incidents and they feel that you won't pull the lawyer card, they will try to attempt this.

kanina lang sa intersection, nasa rightmost lane ako nakastop, to my front is a delivery van. nung nag green light, yung van sa harap ko was turning right, so napachange lane ako sa middle lane., nang biglang nagsudden stop yung van, naalanganin tuloy ang pagchange lane ko so preno din ako..
pagkatapos may sumigaw ng Pu&%#ng %$# mo!!! ayun napamura si van driver, nak ng pating, may mc driver na pumilit dumaan sa right side ng van dere-derecho, parang lagi sira ang preno nila...
tsk tsk, tapos may abangers kotong cops in tandem pa a few meters ahead.. hinayaan lang nila yung mc driver..

One of the most annoying moments parin is kung nagmamdali ka sa umaga, politely stopped by a traffic light, and being swarmed by motorcycles going to the front (effectively walang paki sa pedestrian lane) and then once the green is lighted, until 30km/h lang silatapos hindi ka pa makasingit kasi ang dami nila.

iwasan na lang nating gumamit ng mga masasakit na salita para tuloy lang ang ligaya. iwasan na din sana yung panglalahat.

+1 ... and its not just early in the morning. Its all day long and into the early evening. At every stoplight on major roads.
When the light turns green, the damned things accelerate as if they were pedal bikes and they don't even have the common courtesy to stay on the right most lanes to give way to faster moving traffic.

iniiwasan namin ang di pagkakaunawaan between the 2 communities. please try to understand my post. wala akong binabangit na because they are poor.. etc.. etc... yung panglalait ang sinasabi ko. basahin mo din most of the recent comments. kaya nga after ng ilang pages ngayon lang ako nakisali sa inyo.
