    1% sa commercial vehicles, kasama na yung Fortuner dun. 0.5% pag cars only kaya 9.5T lang ang participation. Pa ayos sa Toyota is 3.5K per panel.

    dapat hindi mo pinakawalan iyun ogag na iyun, dalhin sa precinto at bayaran niya iyun damage at perwisyo naidulot sa iyo...

    pag maliit lang ang damage, talo ka sa insurance... pa-estimate mo iyun damage sa kotse mo at tignan mo kung magkano participation mo sa insurance policy...

    ganyan din nangyari sa adventure ko, iyun naka motor na bumanga walang lisyensya at walang pambayad... lalim pa ng tama, sa driver side door... tanging magagawa eh sinapak ko nalang sabay sabi "amp !*#$%, ano lalaban ka! !*#$%"

    Talagang nakakainis yan kahit kapiranggot lang ang tama ng kotse mo. Last year, yung 3.5Q ko wala pang isang linggo nang binagga ng taxi. Laki ng tama kya pinagbayad ko ng P20T pang participation at abala.

    kung may connection ka, ipa-trace mo sabay sindakin sa bahay nila
    malamang yung motor na yon walang papeles, kaya pwede mo ring ipa-impound. at wag ka padala sa mga paawa awa effect

    ganyan nangyari sa lumang 114 namin sa probinsya. mom ko nag drive at binangga ko ng motor. tumilapon si g*go at balak pang tumakas, buti nalang si ermats medyo matapang, sinugod at nagpatulong sa guard na malapit.
    wala palang registration si loko
    ayun pina-impound namin, nakipag-areglo na bayaran daw ng 4K, e yung expenses ng paayos aabot ng 8k. di kami pumayag, hanggang ngayon nandon pa rin ang motor nabubulok lang. iba talaga pag ma-prinsipyo hehe di baleng lugi kami as long as justice is served

    For those who aren't familiar with the legal process, ang normal comment talaga eh i-demanda, para madala. Well, once you get a taste of it, you will regret the decision to sue in the first place.

    Judges in MM normally are overburdened with cases, especially the Metropolitan/ Municipal Trial Courts, kasi mga BP22 cases na less than P400k ang disputed amount, sa kanila bumabagsak. Kahit sinong judge ang tanungin mo, pag minimal amount lang naman ang pinag-uusapan, they will have to refer that to mediation, which in itself is a boring and lengthy process. Mandated din kasi ng Supreme Court. Also, there are fees you have to pay (initial P500 ata per party), and the mediator also gets a cut on the compromise agreement, depending on his/her seniority. So, gastos na naman.

    Ang mga litigation lawyers ngayon, they charge acceptance/ engagement fees, tapos normally P2..5k per hearing. Then there's also the matter of docket fees. So, kung minimal lang talaga ang amount, pag-usapan nyo na lang. Then as I said, let your insurance firm handle the problem.

    Now, kung tinuloy talaga yung demanda, at nanalo ng favorable judgment, (I'll focus na lang muna on the civil aspect), naturally may writ of execution na i-issue yung judge. You have to pay the court sheriff (lagay at pang-meryenda), for him to implement it. Kung minimal amount lang ang nakalagay sa judgment, baka hindi pansinin ng sheriff yan and you have to pay him extra. Kasi, based on our experience, priority ng mga court sheriffs yung may malaking monetary judgment, kasi malaki din yung lagay sa kanila. I've never met a sheriff na pumayag mag-implement ng libre (Valenzuela and QC). Ganyan talaga kalakaran, and its hard to go against the flow. Nothing will happen. Sometime's talaga, life's a bitch.

    Got your pm to trace the owner but I am currently indisposed. I strongly suggest that you charge it to experience and just have the damage repainted. I have had my own run-ins with fellow MC riders and I dont think im less forgiving despite the fact that I also ride. One time hinabol ko hanggang sa stop and hinawakan ko sa likod ng helmet, bang tumba pag-andar pero tinulungan ko pa rin tumayo

    Galactus is right with regards to the legal process. I've also been there before when a bike hit my rear, driver flew up to the windshield, cracked the windshield, fell, and later on with God's luck stood up as if nothing happened. Bad side is walang lisensya nung nasa police precinct na kami. Pinakasuhan ko... it did take almost one and a half year, something that I cannot afford at the moment.

    I took into your consideration guys of letting the insurance take care of things. So far, negotiations with my insurance is so-so... participation is 8499, and although it's nothing near the value of my car, looking at the scratch, I think... that's more costly than seeing a biker speed-off after scratching it in the first place. So, I went to the Ultimate Paint Shop in Bautista, Makati, for a check, and for the panel 4000 lang. Tapos may more than 5 units na raw sila na black na camry na napinturahan at may record na raw sila ng timpla ng pintura. So, that means I'd have to go to my own way of fixing the scratch if in case I don't want the extra cost.

    BUT, going my OWN way would mean letting the biker go in his OWN way as well... which is something I don't want to accept and still would not accept even after confronting him this Saturday afternoon (kaya di ako nakareply agad dito, nilakad ko kasi agad). It is unfortunate that Sir fireblade cannot give the info due to his status, but I'm fortunate enough that a friend of mine has a relative working in the admin part of LTO. Kaya Friday around 6PM, nakuha ko ung details.

    I went to the police station in Paranaque Saturday afternoon to coordinate with the police and make a police report. I asked kung pwedeng magpasama sa isang pulis kung sakaling puntahan ko ung tao at i-confront ko should I seek for an amicable settlement of the matter with him. Sabi ng pulis e irelay nya na lang daw sa Paco Station Office (taga-Paco kasi ung mayari ng motor). So, deretso ako Paco, and bandang hapon natunton ko ung bahay niya sa may resettlement dun (some would say squatters area but I dont like using that term) together with a police named SPO2 Sanchez. Nung nakita ko ung motor na nakaparada at nakasabit pa ung helmet, sabi ko sa pulis un na un. So, kinatok namin ung bahay katabi ng motor, tinanong namin kung andun si Kenneth Manlapaz. Mayamaya lumabas, anak ng #!!*! Pulis din pala! At ang unang bati pa ng pulis na kasama ko ay "Uy Chief! Kayo po pala!"... hay naku, yari na. Tinanong kami kung bat ako andun, sinabi ko na ako ung tinakbuhan niya sa service road sa Bicutan (Ano nga ba ginagawa niya sa Bicutan gawa ng taga-Paco pala siya? And take note: ung body built niya matches ung built nung taong nag-hit and run saken). Parang nagulat, tapos tinanong ako, "Pare, sigurado ka ba diyan? E pulis ako e? Di ata ako tumatakas sa tuntunin ko a?". Sabi ko, e un po lumabas sa records e, bago niyo po binili motor niyo di po ba? Reply nya, "Oo ako 1st owner nito. Teka, ano ba nangyari?".. Inexplain ko sa kanya then mayamaya tinanong kung dala ko ba ung sasakyan. Since dala ko at pinarada ko sa may Ford Otis, pinuntahan namin. Pagpunta dun at pagturo ko ng gasgas, "Sus! Ang liit lang Pre e? E kahit umamin man ako na ako tumama jan e tingin ko di mo parin mapapatunayan sa korte na ako dumali niyan!".. worst, kinampihan pa sya nung kasama ko, anak ng pating. Hinirit ko uli ung hit-and-run na kaso, ang sagot saken, "Eh pano mo nga mapapatunayan na ako nga dumali niyan? Pre naman o." Binirit ko naman na "Eh pano ko malalaman plate number mo kung di un ung nakita kong plaka nung motor na un at un ding nakaparada sa tabi ng bahay mo na tumakbo na nandali sa sasakyan ko?". Sagot saken "Ikaw naman o, e ano balak mong gawin ngayon? Kasuhan mo ako?", sabi ko depende kung babayaran niya ung 4000 pangrepaint ng gasgas o hindi.

    Andami pang areglong sinubok saken. Kesyo ang laki namin daw, kesyo ang liit lang naman daw ng gasgas, kesyo may sasakyan din naman siya (ows?) na nagasgasan dati at pinarepaint niya ng 500 lang, etc.etc... up to the point na ginamit na niya ang pagkapulis niya para lang makalusot siya. Kesyo pwede ko raw gamitin ung pangalan niya panglusot para sa kahit anong violation etc. etc.. Eventually I finally concluded na sya nga ung nakadali based from how he's trying to bribe me off either charging him the amount for repaint or suing him. Finally, I gave up, and just told him na antayin na lang whether imbitasyon ng korte o pangungulit ng insurance ang darating sa kanya o baka masuspendido pa siya sa serbisyo. Sheesh... gamalas naman talaga at pulis pa.

    So, it's either I let insurance handle it, or I go to court, or I go to PNP to file a complaint for the guy. Which is which??? Hirap pagisipan... hayayay...

    pakasuhan mo nalang sa insurance at baka balikan ka pa nyan.
    tapos a few years down the line, take out a hit on the guy. or since the plate number is burned in your mind, you could accidentally "nudge" him the next time you come across him.

    Napolcom which is right beside my office. I am not very sure though as it is out of his duty or role as a policeman when the damage was done. Medyo magastos lang pero depende sa insurance, sila na lang maghabol yun nga lang malaki ang participation. I admire your guts to pursue the culprit and even went as far as confronting him. Try Napolcom it might help pero takaw oras nga lang. Hope you got his contact details for him to be called for a hearing. Not sure lang kung "abuse of authority".
