    Not so. You are also obliged to cover the cost of lost income incurred during the repair. For example, the owner has to take a leave of absence to oversee the repair (lost income/productivity), transportation cost to bring the car to the shop, etc.

    You may have to abide by company policy, but the other party is not legally mandated to do so. It would be a big hassle for him, and would take a lot longer than outright payment

    IMO, 2,500 is a fair price, pero pwedeng daanin mo na lang sa tawaran at pakiusapan. NEVER (as suggested by one poster), resort to the tactic of subterfuge and daring him to file a court case. Bad strategy. You wouldn't want this to happen to you rin di ba? Anyway, it was your fault.

    opinion:

    1. right: you have to restore the damaged area to its pre-gasgas state. it was your fault. if you were in her shoes, you would demand the same thing.

    2. right: the aggrieved party "may" validly claim for compensation for time wasted in bringing the car to the shop for repair plus other incidental expenses. (although if that is a claim made in a suit, it may not be granted by the judge. kitid utak mga judges natin e. in western and other progressive countries, yes. dapat lang naman.)

    3. right: it will be less expensive to pay P2,500 than to refer the matter to the insurer. all you need to prepare is a release, waiver and quitclaim (hanap ka lang ng pro-forma and fill out the blanks). additional cost is notarization fee (P100 to P200). through insurance, you need to submit at least a police report and an affidavit about the incident (which is more complicated to prepare -- you may need a lawyer to draft this -- plus you pay cost of notarization, also around P100). the repair will take some time because the insurer's adjuster may have to verify the damage and the car may have to repaired by the insurer's accredited shop. there is a possibility that the insurer will deny the claim, thus, making all your effort in preparing the required papers useless. if you contest the denial before the insurance commission, you have to attend to all the concilliation conferences/hearings. total waste of time. there is also a possibility that the insurance commission will deny the claim. at the end of the day, you will have to shoulder the cost of the repair.

    4. the time you spent thinking whether to pay the P2,500 or not is priceless. you could have simply paid it.

    5. if it was your car, the frustration of having a 2-inch gasgas is more priceless. imaginine mo na lang kung ano ang dinadamdam ng babae habang siya ay nagpapaliwanag sa may-ari ng tsikot kung anon ang nangyari.

    6. save your company's car insurance for more serious accidents na maaring mangyayari habang ikaw ay nagdadrive it. wag sa gasgasan lang.

    7. "kung" tuso ka talaga, you can simply refuse to pay and deny the incident to have happened. it is bad. but can be done. chances are, however, the agrieved party will not sue you. suing you is more expensive than just shelling-out P2,500 for the repair. and the case against you may be difficult to prove. pero kung yong owner ng car ay abogado or may kamag-anak na abogado, puede ka namang pagtiyagaan at kakasuhan. if that happens, ang P2,500 ay kulang lang yan sa appearance fee ng abogado mo. at sa isang appearance lang yan. kahit ma-acquited ka pa (if criminal) or if you can have the case dismissed (kung civil case), talo ka pa rin. your expenses would be 77 fold. even more.

    8. always remember that what goes around, comes around.
