    Witnesses are only as credible as the amount paid to them or the amount of intimidation they received from the police. The police in this country are a bunch of corrupt crooks disguised as law men.

    Sad to see that the whole incident probably started as a traffic altercation between the victim and the LBC driver. Poor decisions made led to the their deaths. Especially since they were riding a small motorcycle which in this country automatically makes you either a nuisance or a criminal due to all the unfair negative press small motorcycle riders receive.

    any follow ups to this news by the media? What's the deal regarding the GMA news about the ID's recovered from the victims with multiple different names on them? Why did they shoot at policemen? Mukhang suspect din ang action ng victims. I hope though true justice is served in this case.

    Especially if you ride in tandem, intercept a commercial van and point a gun at the driver to stop.

    The people in the gas station who called the cops thought it was a Hold-Up....and reported it as such.

    GMA7 ang nag-report that they fired back or so that was the info fed to them by the cops. Siguro ayaw na lang mapahiya kaya hindi na sila nag cover ng event. I'm not a PNP investigator but as per the family, puno ang mags ng FA ng mga victims (ano yun, chamber load lang ang pinaputok?) when they identified the units. Not sure also regarding the other details at this time. The point of contention of the families is that the use of lethal force was uncalled for. It is the police officer's job to assess the situation at the time of the encounter.

    I do errands with private plainclothes security providers from time to time. And there are times that they have to present or draw their weapons or their FA's unintentionally become visible while carrying out the function of their work. There was a time in Divisoria (the boss likes doing regular stuff like regular people) when the a path needed to be cleared (people were blocking the way). While the operator was doing his job, the pistol on his waist unintentionally showed. Instead of adjusting his wardrobe, what he did was grip the pistol to retain it. So it means, if someone shouted that he was being robbed by the operator, the cops would just start shooting? Medyo mainit pa yung mga tao sa paligid that time since they were being brushed aside to make way.

    Madaming complex scenarios and it's up to the officer to assess the threat level and the degree of force to be used considering multiple factors. This event only makes the anti-gun Nazis happy.

    There are two establishments in the crime scene with separate CCTV systems. It's seems that the images they captured are still 'unavailable' to the family. The cops and LBC driver are still in hiding.

    From the available info, there was no intention to rob the LBC van (the victim's were not exactly in need of money or whatever you can find in an LBC van, their own private fire truck fleet makes our fleet look like crap). There were no shots fired from the victims' side, and the missing CCTV footage can prove that the victims had indeed shown signs of surrendering before they were turned into swiss cheese.

    Oh, and valuable items were missing from the victims. The cops are saying that maybe the items were stolen by bystanders (what a secure crime scene) or by the funeral parlor personnel. But that's another story.

    Just borrowed this from some friends:
    Rule 8. USE OF FORCE
    SECTION 1. Issuance of Warning
    The police officer must first issue a warning before he could use force against an offender. The warning is issued for the police officer to identify himself and to give opportunity to the offender to surrender.
    The duty to issue a warning is however not absolute. The directive to issue a warning is necessary only in situations where several options are still available to the police officer but in cases where the threat to the life of a police officer is already imminent, and there is no other option but to use force to subdue the offender, the law enforcer’s failure to issue a warning is excusable.

    SECTION 2. Reasonable Force
    During an armed confrontation, only such necessary and reasonable force should be applied as would be sufficient to overcome resistance put up by the offender; subdue the clear and imminent danger posed by him; or to justify the force/act under the principles of self defense, defense of relative, or defense of stranger. The Officer-in-Charge of the operation shall, at all times, exercise control over his men in the area, and shall exhaust all possible means so that no innocent civilian is caught in the crossfire.
    The reasonableness of the force employed will depend upon the number of aggressor, nature and characteristic of the weapon used, physical condition, size and other circumstances to include the place and occasion of the assault. A police officer, however, is not required to afford a person attacking him the opportunity for a fair or equal struggle. His duty requires him to overcome his opponent. In the lawful performance of his duty, the police officer must stand his ground to accomplish his mandated task of enforcing the law and maintenance of peace and order.

    SECTION 3. Use of Weapon
    The excessive use of force is prohibited. The use of weapon is justified if the suspect poses imminent danger of causing death or injury to the police officer or other persons.
    The use of weapon is also justified under the Doctrines of Self-Defense, Defense of Relative, and Defense of Stranger. However, one who resorts to self-defense must face a real threat on his life, and the peril sought to be avoided must be actual, imminent and real.
    Moreover, unlawful aggression should be present for self-defense to be considered as justifying circumstance.

    SECTION 4. Reportorial Requirements
    Any police officer who used his firearm against a suspect must submit an after-encounter report outlining the circumstances necessitating the use of weapon against the suspect.

    Rule 9. MOVING VEHICLES
    A moving vehicle shall not be fired upon except when its occupants pose imminent danger of causing death or injury to the police officer or any other person, and that the use of firearm does not create a danger to the public and outweighs the likely benefits of its non-use.
    In firing upon a moving vehicle, the following parameters should be considered:
    a. the intent of the fleeing suspect/s to harm the policeofficer or other persons;
    b. the capability of the fleeing suspect/s to harm in certainty the police officer or other persons; and
    c. accessibility or the proximity of the fleeing suspect/s with the police officer and other persons.

    THINGS TO BE DONE AFTER AN ARMED CONFRONTATION

    Immediately after an armed confrontation, the Officer-in-Charge shall:
    a. Secure the site of confrontation;
    b. Take photographs;
    c. Check whether the situation still poses imminent danger;
    d. Evacuate the wounded to the nearest hospital;
    e. Ensure that all persons who died on the spot are not moved from their original position. Arrested suspects, on the other hand, should be kept in isolation;
    f. Conduct debriefing on all involved PNP operatives; and
    g. Submit After-Operations Report.

    Just answer this question OTEP.

    How would the Gas station people, who reported the LBC vsn being stopped at gunpoint, know that the guy was Rich and this isn't a Hold=Up?

    to be fair din doon sa LBC driver, if a tandem riding motorcycle pulled a gun on him, holdup kaagad ang iisipin niya. more so na holdup na siya dati...

    one question still bugging my mind, bakit meron dalan baril yun mechanic? it's really not normal...
