Is it that easy to prove a DUI based on affidavits? Hit and run naman, if she had the car repaired, would be a little tricky unless the repair was coursed thru insurance or ugly and haphazardly done and obvious.

Yup yan rin sabi nung police officer. Mahirap iprove yung DUI since tumakbo yung driver. Magiging witnesses' word vs her word.

Reimbursable pala ang participation pay?

Tatlong beses na ko nabangga and I had to shell out a participation pay for all of them.
I tried to collect from the other party myself, pero laging walang nangyayari, pinagtataguan ako kaya pinapabayaan ko na lang.

Sino dapat ang magrereimburse sa akin pag ganun? Yung insurance ko o insurance nila?

^Yup parang ganyan rin hinala ko. Pero i don't think own damage yung gusto palabasin nung agent. Gusto nya ifile ko na walang witness sa incident. Sabihin ko raw pagkakita ko sa car, may tama na.

Pero pag dating sa insurance, hindi na sila nag file ng case, kasi mas magastos daw, dahil siguradong lalaban yung insurance ng offending party. Lalo na MS 2010, Prudential sigurado insurance nyan. At second point nila, mahina daw ang kaso pag ang police report ay hindi account sa actual accident, meaning hindi actual na nakita ng police yung accident site on the time of the accident. Maliban lang daw kung may criminal intent yung accident may chance daw sa korte yan, normally hanggang fiscal lang daw yan. Kukuha ka ng abogado, magkano acceptance ng abogado ngayon, tapos per hearing pa sa fiscal level. Kung ang participation ay P5T better talk direct to the monty owner providing she will admit it then beg her to settle the participation cost.
