Under A.M. No. 08-8-7-SC, the jurisdictional amount is not over 100K, that is why any first level courts designated as SMALL CLAIMS COURT nearest to the plaintiff may have jurisdiction. I believe that it would be more taxing for TS to file the criminal aspect. Assuming the children involved are 15 y.o. or below, no criminal liability would lie against them. If ever these children would be detained, by law the parents and DSWD can demand for its immediate release.You cannot sue the parents either for the criminal offense that the children committed. That is basic. Assuming too, that the children are over 15, should we advise the TS to go through the proceedings of discernment determination and diversion? That is the reason why in my previous post I just discuss the civil aspect. There is no point discussing their respective criminal liabilities.
I have advised my clients to go to SCC straight. Lawyers are not allowed inside to represent under A.M. No. 08-8-7-SC, except when the lawyer is a party himself or herself. With regards to children, under the law you cannot possibly hold them for anything. I have represented a 16 year old in a drugs case but I was able to secure his release through recognizance. My client did not pay any single centavo for the bail bond. If a lawyer wants to always win a case, represent a child in conflict with the law. It is so easy representing them, the law is so gracious.
Actually we have laws designed for citizens to have access in court.

in two weeks time sir may decision na agad, pakitanong yung exact details kung pwede, sir diko muna sabihin kung saan baka kasi member din ng tsikot yung tatay ng nakadale may kotse din yun.
thanks sa info sir, bago ba yang small claim court, nakita ko din sa commercial yan, malaki naman ba chance ko na makuha agad yung nagastos if ever na magsampa ako dyan, parang ayos i try yan

ok sabihin ko sayo sir pag natapos process sa barangay, di pa kasi tapus proseso nila, tignan ko muna mangyayari, sa ngayon dko muna iniisip small claim court baka madaan naman sa magandang usapan pero if ever na walang mangyari, then pati ko i grab yang small claim, gusto ko din itry yan kung effective, para kung sakaling maulit, meron nang matatakbuhan

thanks mga katsikot... mababawasan na din mga problema, naging tropa na din yung tatay ng nakabangga, since na magkakapitbahay lang naman, pero nung una halos nagtatalo na kami sa barangay, hindi kasi agad nagpakilala, nung makita yung sira kaya naman pala gawin ng kakilala nilang may talyer, kaya hindi na nasunod ung 3500 petot na estimate ko, pero ok lang, kilala ko din yung gagawa, yun din yung all around mekaniko sa isang shop na suki ako.

January 14th, 2013 04:48 PM #80i agree. tsaka dapat alam mo na din na pwude mangyari to sa kotse mo. expect it na kumbaga. kasi sa labas mo pinarada. i used to stay in cavite where may sarili akong garahe. pero nung lumipat ako sa pasay. walang garahe ung tintuluyan ko so i rented a space na malapit lang. magastos pero responsibility ko na ilagay ung property ko sa hindi abala. masikip na nga yung kalye paparadahan pa. ndi naman ako katulad ng iba e na ndi nagiisip. not pertaining to ts a. hehehe. and kpag may parking space talga na wala sa kalye. secured ung kotse from gasgas and banga and iba pang band elements.
