    I think there is indeed a presumption that the driver of the vehicle behind in a collision is at fault on the premise that both vehicles are moving forward and that the driver at the back would be in a better position to avoid the accident. However, this presumption is not conclusive but merely disputable. Presented with contrary evidence the investigating officer should take a neutral stance on such a case.

    So, really it is not a law but merely a disputable legal presumption. Kaya nga lang base sa nangyari malamang magsisinungaling ng husto yung driver ng van at kung yung traffic enforcer eh, medyo corrupt, malamang magkaroon pa ng kaso.

    That's why I think in keeping your cool and letting it go was the best way to handle the situation. In my experience, minor accident with little damage should always be handled like so. I don't trust traffic enforcers anymore. They will most like try to profit from your misfortune in cahoots with the other party especially kung hanap dilihensya rin yung kabila.

    Sa Rules of Court yung mga legal presumptions pero not really sure sa rear vehicle presumption.
