    in cases such as these, isa lang nasa isip ko. kawawa yung bata... kung baga, naiipit sa dalawang naguumpugang bato...

    very true sir gilmore, im advising nga sya na to get the child na lang, sya man ang ama or hindi, basta ang custody is purely sa friend ko and the wife to stop bugging him, but i know this is a tough situation.. and almost imposible sa laws natin, basta girl sa mother yata lagi eh.

    hindi naman parati sa mother ang bata... afaik, if the father can prove to the court na walang means yung mother of raising the kid properly (financially, emotionally, etc.) pwedeng ibigay ang custody ng kid sa father.

    there's such a thing as the tender years doctrine, where no child below 8 years of age will be separated from the mother except for the most compelling reasons. in the past, compelling reasons would require the degree where the child is endangered such as when the mother is abusive, takes drugs or lives with another guy. lack of financial capability by itself is not a compelling reason which is why they can file for support.
