    I'm among those employees whose annual income is above that range. Included or not, we don't tell our financial standing to anybody...unless you want to be the target of carnappers, kidnappers, or in this case, BIRnappers.

    And I thought this is a free country, where I can spend my money, after the tax deductions, where and when I want to.

    Tama ka Altis, witch hunt ito. Yari ka kung mayaman(?) ka...

    Kung meron taga-BIR dito the thread, paumanhin po. But poking in someone's financial affairs, with no probable cause, is tresspassing already. Tresspassers will be shot, and survivors will be dog food...

    and if they can't get the few big fishes, who are protected by cpa's and tax attorneys, to pay the appropriate tax, they will resort to harassing the many small fishes who are more apt to comply since they can't afford professional help

    yeah, I think the govt is also planning to increase their pork barrel kasi for senators and congressmen. Kaya they need all the funds they can get.

    *Altis:i guess they just want to circumvent the proscription in the Bank Secrecy Law and further intrude into the private economic affairs of its people. Want to increase the revenue? They should intensify the effort to come up with honest collection. They should inspect into the highly irregular system of tax assesment...assess the taxpayer with a ridiculously high assesment, e.g. Assesment of 5M but at the end of the fiscal year, the taxpayer so assessed would just pay 50K based on the receipt. Also, they should instead strengthen the payment under protest. No taxpayer would resort to this because the resolution would take years, decades. So if youre a businessman, the 5M would go a long way. Why pay? Dami problema sa enforcement, wag nila dagdagan ng measure which is devoid of any consti basis.

    The Secretary may have the power to issue rules, but the question is: is there a law that requires SALN like docs from people in the private sector?
    The spring cannot rise higher than its source.

    why don't the BIR clean up their own backyard first? OK lang sa akin mag-file nyang SALN na yan kung may guarantee na matitino ang titingin ng dokumento at di ka gagawan ng paraan para mangikil.

    wala akong tiwala dyan sa mga tauhan ng BIR, pag umabot ng inspector level, corrupt na.
    kaibigan ko ilang beses hiningan ng 200k pang-areglo ng Tax Inspection nya.

    kaya nung may itinumbang taga-BIR sa Antipolo ang sabi nya "sige, ubusin na nila lahat yang mga buwaya dyan"

    And by the way, this is worst than the National ID system that had been repealed by the SC.

    This is out right invasion of your privacy. Imagine, not only where you live or work, but everything you own!
    There should be a citizen suit against kim henares!

    MANILA, Philippines—For the second time in less than a year in office, Bureau of Internal Revenue (BIR) Commissioner Kim Henares has been forced to retreat on a controversial measure designed to boost revenues.

    Henares has agreed to pull out an agency order mandating private individuals earning more than half a million pesos a year to submit what was practically a statement of assets, liabilities and net worth (annual information return or AIR) after getting a virtual lecture from more than half a dozen lawmakers at the House ways and means committee hearing Tuesday.

    Henares told the lawmakers she would recommend the withdrawal of Revenue Regulation No. 02-2011 issued March 1 compelling individuals earning P38,462 a month to file an AIR with their annual income tax return on a voluntary basis initially this year and to become mandatory starting next year.

    Cagayan de Oro Rep. Rufus Rodriguez said that Henares apparently realized her error after lawmakers “argued with passion” against the AIR.

    Unconstitutional

    “It is illegal because it did not pass Congress. It is unconstitutional because it violates an individual’s right to privacy. It is undemocratic because it was done without any consultation,” Rodriguez said.

    Bayan Muna party-list Rep. Teodoro Casiño said: “I am happy that Commissioner Henares has seen the light on this matter. The BIR already has all the information needed to enhance revenues and go against tax evaders. They should just do their job properly rather than burden taxpayers with questionable and practically useless regulations like the AIR. I hope this is the end of it.”

    Question Hour

    Rodriguez said that should Finance Secretary Cesar Purisima refuse to heed Henares’ recommendation to withdraw the AIR, lawmakers would compel her boss to appear before the House committee in a Question Hour.

    This is the second time that Henares had to take a step back on a policy measure after the Supreme Court issued a temporary restraining order against her proposal to impose a 12-percent value added tax on toll rates, a proposal which was also savaged by representatives and senators.
    Oh well.....

    Being a lawyer, she should have been more circumspect on how she does her job, and not going the "unconstitutional" way about it. Let her run after the big tax evaders (she was involved in the run against tax evaders project, or RATE, that caught up with a couple of celebrity actors/actresses and professionals in publicized incidents), and not make life difficult for the overburdened salarymen.

    Of course congress will be against this. They're protecting themselves and those who support them.

    If individuals are made to submit SALN, it wont help really as those who have the real money know how to hide their assets. If you do checkings, you'll find that most of them really dont have hard assets under their names as these would be hidden under corporate layers and dummies; also easier to transfer to your heirs later on.

    Tama lang na de matuloy yan, ang mangyayari lang naman dyan pag nakuha nila ang SALN, alam na nila sino ang hihingan nila nang pera, mga Buwaya talaga ang BIR
