    pwede po makride sa thread nato?

    situation po is: a house and lot owned by an OFW with a clean title ,kaso pinabebenta nya sa kapatid nya so she issued an Authority To Sell na SPA authorizing her brother to sell it for her .
    since di kaagad maibenta yun property ,etong brother e decided na to pawn the H&L ,bingay nya land title, the Authority to sell na SPA yun Passport ng brother(yung nagsanla) tsaka yun kasulatan na sinsanla nya yun bahay at lupa ,notarized din.

    lipas ng ilang buwan e di pa rin nya tinubos.

    Question : me authority na ba na ibenta ng pinagsanlaan yun property?ano po ba yung magandang sulotion dito?

    wala pong authority to sell yong mortgagee (sinanglaan ng H& L). In fact, the mortgage contract is void because the authority given by the OFW to her brother was a special power of attorney (SPA) for him to sell the lot and not to mortgage. Ang magandang solution dyan, bilhin na lang ng mortgagee yong property or convince the mortgagor (brother ng OFW) to induce his sister to make a SPA authorizing her brother to mortgage the property, then, gawa na lang sila (brother and morgagee/sinanglaaan) ng new mortgage contract.

    ang hirap magcomment dito ala ako alam sa law tungkol jan hehehe...

    ako din madami kami prob sa luain namin..

    eto naman po sakin yun pinamana ng lolo ko sa papa ko ay naforeclose ng banko kasi sinanla ng lolo ko noon syempre di binitawan ng papa ko sya nalang naghulog... ang problema nagkamali sa lagay ng first name ko parang pinalabas na tenant ako ng farm na yun na dun din ako natira kaya sakin nalang inaward 3hectars din yun..panu ko kaya mapapalitan un name ko dun?
