    Hi guys question regarding third party insurance claim.

    Nabangga ako ng truck while at full stop at naka red light. Medyo malaki damage 3 panels: left side rear fender na sobrang yupi, cracked rear bumper, slight dent and scratch on the door and deep scratches sa mags.

    Long story short, the truck has comprehensive insurance and the company who owns the truck insisted to file an insurance claim under their policy kahit na nag iinsist ako na bayaran ng cash on the spot yung cost of repairs dahil alam ko na magtatagal sa CASA cause CASA will insist to replace the damaged parts and it will take them a month minimum to get the parts.

    Anyway, pumayag na ko na i-cover ng insurance nila and 2 weeks na ko nag aantay ng LOA. Last update from Malayan(insurance nila) ang sabi hindi daw makakapag release ng LOA dahil hindi pa bayad ang insurance premium ng truck. WTF? Tinawagan ko yung insurance broker nung truck company at ang sabi nakikipag coordinate na daw sila sa cliente nila and was advised to wait for updates.

    Paano ba ang gagawin sa ganitong scenario? I mean, is there anyway na mapabilis ang proseso? Approval pa lang halos abutin na ng isang buwan.

    Sa ganitong scenario na ako yung binangga, ano ba ang rights ko? I mean, do I have the right to tell the company of the truck at fault to just pay for the damages in cold cash and move on? Ako na lang magpapagawa sa labas kaysa sa ganitong napakatagal na antayan. Kung nalaman ko lang sana na ganito pala katagal pag third party claim hindi sana ako pumayag.

    Hi po, since third party of kayo, all you have to do is to follow up, but then regarding sa cash settlement na gusto mo its possible naman as long as the party agreed po...but then meron po kayong another option if you have your own car insurance policy po. That means u can file your claim to your own insurance company po even though ikaw ang nabangga po. And then, ung insurance na mo na po ang bahala dun sa nakabangga sayo po which is iyong truck nga po. You just have to coordinate and ask your insurance agent po.

    Thanks po sa reply. Napagawa na po yung car. Insurance lahat nung truck company ang sumagot ng repairs which is a whooping 65k. The truck company did not pay a single cent. Even participation fee wala silang binayaran as per the LOA. Nakakainis lang dahil ako lang talaga ang na perwisyo nila. Abonado pa ko sa plastidip para sa mags na ni-replace.

    Just a question though for future reference. In case I've decided to use my insurance instead of the other party's, I'd still have to pay for the participation fee do I? Then the insurance company will go after the driver/truck company? Parang lose-lose situation ata kung ganito ang mangyayari. Na perwisyo ka na, nagbayad ka pa tapos kikita pa yung insurance company sa pera na makukuha nila dun sa truck company at fault kung magbabayad sila.
