    i think the bank will earn more from this scenario. kaya nga may downpayment ang banks. para kung hindi ituloy ng buyer ang payment di sila lugi.malaki na rin nabayaran ng TS 20% DP + 1 year payment. that's roughly 35-40% of the price. mas gustuhin pa ng bangko na isoli ng lang buyer( with updated payment ) rather than hatakin ito ( non-payment). but for sure bad record ka na.

    paano na pala yung chattel mortgage kung ibebenta agad ng agent yung car assuming na may under the table? Di ba nakalagay sa rehistro yung name ng bank na nakamortgage ito at yung name ng owner as owner of the car? Kung ililipat ito sa pagpapasahan na buyer kailagan pa uli ng bagong rehistro nito at mortgage di ba?

    Loaner pays D/P to the dealer. Balance borrowed from bank, car encumbered in favor of the Bank. Loaner pays monthly amortization. Loaner chooses to return car to Bank. Account is current.

    Bank does not usually allow this. It is likely that Bank personnel assumed balance. But the Loan is clearly active and not consummated or completed. If the Bank or bank personnel assumes balance and defaults, its still the Loaner's ass on the line. TS has not specifically mentioned that he has papers in his possession clearing him of his obligations, therefore, he should be wary about the Bank's leniency. He will lose in the end if there is a default.

    This case has potential double whammy written all over it. TS should take care of this quickly.

    He already lost the usual DP plus the months he already paid. . Assuming na makuha kayo ng zero% DP. Weirdo lang ang nakakakita na may advantage to.
