    Nabasa ko na po yung mga threads dito tungkol sa open deed of sale pero clarification lang mga paps

    karamihan kasi ngayon nang nagbebenta ng 2nd hand puro open deed of sale. so halimbawa, may binili akong oto na open at may pirma at details na yun ng vendor at fill in the blanks na lang ng details ko.

    1. Paano ngayon yung acknowledgement sa notary public, kailangan ng number ng sedula nung vendor? Paano kung wala kang mahagilap na details nun?

    2. Puwede ba sa acknowledgment ng notary public na yung vendee lang ang nag-appear before him/her? Tatanggapin na ba ng LTO yun para sa transfer?

    3. At requirement ba sa transfer of ownership yung acknowledgment ng notary?

    - actually, a cedula or another government issued ID which is somewhat permanent is accepted (pwedeng SSS, TIN o Passport #)

    2. Puwede ba sa acknowledgment ng notary public na yung vendee lang ang nag-appear before him/her? Tatanggapin na ba ng LTO yun para sa transfer?

    Bro, I'm not a lawyer but let me give you some insight based on experience. First, open deed of sale are intended and used by sales people. People who buys and sold car for a profit and they dont intend to register the car on their names.

    Second, If you are not a car salesman and happen to buy a 2nd hand car you can opt to tell the seller to change the open deed to a close deed with your name properly indicated therein.

    Third, if you are not a car salesman but opted to re-sell the unit on a later date, it will be preferable to use the open deed because this saves you on cost of registering to your name. But make sure all the necessary information of the seller are there,i.e., his/her sedula etc. and properly notarized. If not then this is a problem. Notarizing incomplete documents will give you a headache.

    no matter how haywire your open deed of sale is, if no one complains, papasa yan. the problem is, kung may mag-complain. then you're in hot water.
    i'd spend a little more, just to be sure the documents are in order. that means, i'd choose who i'm buying the car from.
    it's really the pinoy mentality: kung puedeng lumusot, susubukang lumusot.

    hingi ako ng tulong mga sir.

    ito ang situation:
    open ang deed of sale. seller is supposedly the 2nd owner, but not technically since hindi niya pina-transfer sa kanya yung ownership ng car. i'm the buyer and will be the 3rd owner if the transaction has been completed.

    questions:
    - kailangan ba mag-appear ng original owner sa notary public pag nag-proceed na ang transaction?
    - sa papel, lalabas na ako ang 2nd owner lang. pano or anong steps/procedures para ma-aaccomplish 'to?
    - i want to be cautious, kailan ko ba kailangan ibigay yung pera? before or after ma-notarize ang deed of sale?
    - pano ako makakasigurong binding ang deed of sale kung may open deed of sale pa ang seller and original owner?
    - ano ang steps para ma-check sa LTO na valid and OR/CR na hawak niya? tawagan ko lang LTO or kailangan i-check nila mismo physically yung car?
    - same question din above pero sa TMG/police clearance naman. itatawag ko lang ba? anong data ang kailangan kong ibigay sa TMG para ma-verify nila kung hot car nga or hindi? thru tawag lang 'to or kailangan ko mag-fill up ng application form for TMG clearance?

    Bumili kasi ako ng 2nd hand car pero tinatamad ako ilipat sa name ko. Kung ibebenta ko uli bigay ko lang yung unang deed of sale namin ng 1st owner, at bagong deed of sale ng namin ng buyer?

    Pwede ba yun?

    Dami kasi ako naririnig may mga kopya sila ng open deed of sale e para kung sakaling ibenta uli.
